Why did the Supreme Court fine former Defense Minister Diego Molano?

The Supreme Court of Justice sanctioned the former Minister of Defense, Diego Molanoand two other officials because they did not collaborate with justice and generated a delay in the resolution of a labor conflict in which the social security of a worker was involved.

It turns out that the high court asked them for the work history or salary certificate of a man who served for the defunct DASbut did not respond in a timely manner, even partially, and they also did not collaborate with the judges for the practice of evidence.

Then, it is a fine of five minimum wages for the former Minister of Defense, diego molano and the director of the Special Administrative Unit for Pension Management and Parafiscal Contributions of Social Protection, Ana Maria Cadena.

And it’s 10 minimum wages for the director of the Social Liability Fund of National Railways of Colombia, John Mauricio Marin Barbosa.

“The sanction, which was issued last July, was given against Marín Barbosa, Molano Aponte and Cadena Ruíz, in their capacity as representatives at the time of these three entities called to trial in the labor process, because the law determines that these correctional measures must be imposed on those who hold this quality”, said the Labor Cassation Chamber of the Court.

The high court recalled that the judges, according to numeral 3 of article 44 of the General Code of Procedure, can sanction with fines of up to 10 minimum wages to employees, other public employees and individuals who “without just cause fail to comply with the orders given to them in the exercise of their functions, or delay their execution. All this in order to avoid the unjustified paralysis of judicial processes,” he said.

The Chamber also reiterated that every natural or legal person, public or private, has the obligation to collaborate with the administration of justice. “The correct jurisdictional function of the State cannot depend on internal procedures of the different entities whose collaboration is necessary to be able to carry out the judicial activity”, he emphasized.
