After an emergency decision by the Berlin Administrative Court on Wednesday, trees may be felled on a meadow orchard in Adlershof to enable the construction of a new community school. As reported, the Treptow-Köpenick district is planning to build a new community school on a 3.5-hectare site.
A nature conservation association had filed a complaint against the construction project because part of the property had previously been used as an orchard with old trees. “According to the Federal Nature Conservation Act, meadow orchards are protected biotopes that, in principle, may neither be destroyed nor impaired,” said the administrative court on the decision.
Nevertheless, the administrative court found that the exemption from this ban, which the district office had given the state-owned housing construction company Howoge, was legal. “The exemption is necessary in the public interest because the expected demand for school places can only be met by the commissioning of the planned Adlershof community school from the 2025/26 school year,” the statement said. There are no reasonable alternatives in view of the necessary space utilisation. (tsp)
