A 47-year-old man was sentenced to 16 years in prison as author of sexual abuse committed to the detriment of his own son and a niece in the city of Santa Fe. Both victims were minors at the time of the events.

The sentence was ordered by a court made up of the judges Cecilia Labanca (Chairwoman), Gustavo Urdiales y Paul Ruiz Staigerin the framework of an oral trial that took place in the courts of the provincial capital.

The Special Prosecutor Unit for Gender, Family and Sexual Violence (Gefas) of the Regional Prosecutor’s Office 1 was in charge of the investigation and represented the MPA in the debate. In this regard, she stated that “The penalty was imposed by the legal classification that we proposed and the amount is close to the one that we requested in the accusation”.

The Prosecutor’s Office stated that “The convicted person committed the sexual abuse on repeated occasions”and clarified that “the boy began to be violated when he was in kindergarten and the girl, when she was in elementary school.”

“The attacker carried out his criminal conduct against his son at a time when he was left alone with him in a house where they lived together,” the MPA said.

Regarding the suffering of the other victim, it was stated that “on occasions when the girl visited her uncle’s house or he would find her running errands, sexually abuse her and give her money so she wouldn’t tell anyone about what happened.”

Both the son and the niece of the convicted man were in a condition of vulnerability that he took advantage of to commit the illicit acts”, he assured. “Given the difference in age between them, the relationship that unites them and the modality of the abuses, they had sufficient entity to alter the normal and progressive sexual development of the victims”, it was remarked.

Investigation

The MPA pointed out that “the illegal acts had a negative impact on the child, who began to have aggressive behaviors and, without understanding the scope of his actions, reproduced with his peers the situations of abuse to which he was subjected.”

“Noticing the victim’s reactions, his mother went with him to the Primary Health Care Center (CAPS) in the Chalet neighborhood, where they provided him with medical care,” he said. “When it was found that the child’s sexual integrity had possibly been violated, the institution accompanied the woman to file the complaint that gave rise to the investigation,” she said.

On the other hand, the Prosecutor’s Office made reference to the fact that “the condemned man’s niece managed to tell a teacher from the municipal neighborhood she attended that she was abused by her uncle.” In this regard, she stated that “the teacher explained the situation to the coordinator of the recreational space and made the corresponding complaint.”

In relation to the evidence presented in the trial, the MPA indicated that “both victims were interviewed on the Gesell camera and narrated in a coherent and solid way what they suffered.” Likewise, it was added that “both the people who intervened in the information to the authorities and those close to the family made statements that made it possible to clarify what happened.”

Criminal classification

The convicted person was sentenced as the author of seriously outrageous sexual abuse and promotion of aggravated corruption of minors (Due to the age of the victims and, with respect to the child, also due to the relationship and cohabitation).
