In response to the ex officio complaint issued by the Province of Buenos Aires, through the Ministry of Production, Science and Technological Innovation against NETFLIX, The platform modified its contracting conditions, eliminating abusive clauses that limited the rights of consumers.

From this measure promoted by the provincial government, by the Provincial Directorate for the Defense of the Rights of Consumers and Users, consumers throughout the country benefit, since from this update the company stops using laws of the State of Delaware (United States), and adapts to the Civil and Commercial Code of the Argentine Nation.

On January 5, the new Terms of Use of the service entered into force. In this update the company removed three clauses that violated consumer rights under Argentine law:

  • They imposed that the payments made by the consumer would NEVER be refundable by the company, limiting the possibility of claiming and establishing that credit would NEVER be granted in favor of the user.

  • They imposed the resignation of consumers to initiate claims and participate in collective actions in defense of their rights.

  • They established that the Terms of Use would be governed by United States laws of the State of Delaware, in violation of the Civil and Commercial Code of the Nation.

In addition, the clause that conditioned the cancellation of the subscription was adapted, limiting the rights of users and their freedom to contract.

This measure achieves more favorable contracting conditions for users, guaranteeing more rights for users throughout the country and fairer and more equitable consumer relations.
