The trial for the crime of Fernando Báez Sosa that is being carried out in the city of Dolores entered its pleading stage yesterday. In a day full of pain and tension, the prosecutors and the individual victim requested that the eight defendants be sentenced to life imprisonment as co-perpetrators of the crime of “aggravated homicide by treachery and by the premeditated competition of two or more people” in ideal competition with the “minor injuries” due to the beating of the victim’s friends.
After more than ten hours of arguments before the Oral Criminal Court (TOC) 1 of Dolores, the request of prosecutors Juan Manuel Dávila and Gustavo García; and from the lawyers of the victim’s parents it fell on Máximo Thomsen, Enzo Comelli, Matías Benicelli, Blas Cinalli, Ayrton Viollaz, and Luciano, Ciro and Lucas Pertossi.
The presentation of the complaint began with the word of Fernando Burlando, who focused on describing the mechanics of the act, timed the steps towards the homicide and segmented them into four stages, from the incident inside the nightclub that caused the violence to the escape of the eight accused after the beating.
Next, another of the lawyers representing the victim’s family followed, Facundo Améndola, who alluded to the evidence against each of the defendants: he began with Máximo Thomsen.
With treachery and in premeditated competition
“The plan is accredited from the form of commission of the act. They did not choose just any form: they chose a treacherous form”, Fabián Améndola shot at the defendants.
“They agreed to kill among all of them, in the way they were going to do it, they entered to deliberate the way. There is no need to talk about the division of roles because everyone hit Fernando Báez Sosa and everyone prevented him from receiving any kind of help ”.
And he continued: “There was a synchronized attack that we see in the videos. We see it in Thomsen and in “croniquita” (Lucas Pertossi), who is the one who is going to be in charge of taking the images… This attack was coordinated, synchronized, with speed and precision”.
To which he added: “The stalking lasted 7 minutes, during that time, they were surrounding Fernando Báez Sosa and his friends, without them or the police officer noticing.”
After this, Améndola closed: “We never cared if it was Thomsen’s shoe. Death is not produced by a single blow but by a combination of them.
They will investigate alleged false testimony of Guarino and Colazo
Prosecutors asked to investigate Juan Guarino and Tomás Colazo, two friends of the group accused of the murder of Fernando Báez Sosa, for alleged false testimony, who for various reasons were excluded from the prosecution.
Regarding Guarino and Colazo, the prosecutors raised doubts about their testimony as witnesses, since they omitted to provide details about what happened while they were both at the scene.
They seized the cell phones of Enzo Comelli and Blas Cinalli
The Buenos Aires Penitentiary Service (SPB) seized the cell phones of Enzo Comelli and Blas Cinalli, accused of the crime, to investigate whether they made publications on social networks over the weekend.
The kidnapping of the mobile devices became effective after an alleged interaction between the two defendants with accounts that support them on Instagram was made public.
FERNANDO’S MOTHER: “That the judges’ hands should not tremble to give the maximum penalty”
Graciela and Silvino, mother and father of Fernando Báez Sosa, stopped to make statements as they left the courts.
“Really, my son was killed in the worst way. They had no mercy. I want them to pay. Give him the maximum sentence. Let the hands of the judges not tremble”, said Graciela with tears in her eyes.
“I trust Justice,” added Fernando’s mother. “I agree with what the Prosecutor’s Office requested and also with Dr. Burlando,” she said.
Today from 9 a.m. it will be the turn of the defense, headed by the lawyer Hugo Tomei, while the defendants are also expected to say their last words as well as the parents of the boy murdered in January 2020 in Villa Gesell.
