The legal framework for games is under development and it may foresee the payment of an extra tax so that developers can operate in Brazil. The information is from Estadão and was confirmed with the rapporteur for the Bill (PL) 2796/2021, Senator Irajá (PSD).

According to the Tocantins senator, the rate is already being discussed with the Federal Revenue and is similar to the one the government wants to apply in the gambling segment.

We are evaluating whether another contribution would fit. It is a bit of what happens with the discussion on gambling, which created a 15% rate. It’s like a Cide from games. We are evaluating the feasibility of this.

Currently, game companies pay taxes as if they were companies in other sectors. For Irajá, the creation of its own regulation will make the segment more “moved”, and may grow quickly after the approval of the legal framework.

The specific tax can also free some developers from charging the fee of up to 30% in app stores such as the App Store and Play Store.

Due to the creation of this new contribution, Irajá asked for more time before the project is analyzed by the Senate Economic Affairs Committee (CAE).

I asked for more time to consult the Treasury and the Revenue about this. I believe that the proposal will come soon and that, in the coming weeks, we will discuss the topic.

For the time being, there is no forecast for voting on the text in the Senate plenary, but it has already passed through the Chamber of Deputies and the forecast is that the regulatory framework can make the sector grow by up to 300%.

In the case of electronic games, the market estimates that the financial movement will go from the current R$ 10 billion to R$ 40 billion, generating up to 50 thousand direct jobs.
