The round of investigative hearings of the five detainees for the murder of Juan Carlos Katz (37), which occurred in May 2014, was completed yesterday. As reported by this medium, on Monday two of those involved abstained and yesterday there were others. three.
They are Armando “Mandy” DS, Emiliano “El Chino” L. and Eduardo “Pipito” I., who were transferred in the morning before Judge Ricardo Balor, head of Investigating Court Six.
In that instance, after appointing a defender and listening to his elements against him, they also chose the path of silence. As this medium was able to confirm, the five are now being investigated for the crime of murder aggravated by treachery, which provides for a life sentence if they are found guilty in a future debate.
For now, all will remain in custody, pending the progress of the investigation.
As El Territorio has been reporting for the death of Katz, the prescription had been declared last year, but last Friday the Homicide Department of the Misiones Police were all arrested again.
According to what could be reconstructed, the change in the situation of the suspects occurred in March of last year, at the request of an opinion from the Misiones Court of Appeals. The judges then revoked the statute of limitations and ordered further investigation.
“He is instructed to fully assess the evidence and determine if it is not appropriate to expand the instruction and change the title of murder in a fight to intentional homicide,” said a weighty source the day before. The decision was adopted after the opinion in this regard of the prosecutor Andrés Poujade.
The prosecutor considered that the facts described in the file “could be classified as a minimum hypothesis of the type foreseen and punished by art. 79 and, maximum, those provided in arts. 80 inc. 2) or 6) of said normative plexus”. In other words, he assessed the possibility of an aggravated or doubly aggravated homicide.
According to the file, the assault on Katz occurred on May 11, at a birthday party in block F of Prosol II. Juan Carlos was in the place drinking beer, until he had an altercation over a debt with a man, whom he headbutted. A third came out in defense and kicked the watchman, so he decided to leave the place.
But it did not stop there, since the victim was followed by C. Joaquín Alejandro, D. Maximiliano Iván, L. Emiliano Daniel, DS Armando Asunción and Eduardo Norberto I. and once they reached him, at the height of the football goal of the cement court in front of the plaza, they would have violently attacked in a group with blows and kicks in the region of the head, until they left him unconscious, leaving him fainted on the floor,” the file reads (the last names were preserved).
Katz was found dying at the scene and taken by neighbors to his home in a truck. From there, Noelia transferred him to Caps de Itaembé Mini, where they loaded him into an ambulance that took him to the Madariaga Hospital. The forecasts anticipated the inevitable and his death occurred on May 16 at 2 in the morning.
