The background is a shooting at Östergård in Halmstad in 2019 when seven shots were fired in a residential area. Shortly before that, the suspects were caught on video handing over a gun.

The suspicions have been that the lawyer passed on information between his detained client and the others involved that a jammed, unusable, gun had been placed in a basement. Something the client, who was suspected of aggravated weapons crime and attempted murder, then brought forward in the courtroom as evidence that the gun was not sharp. The prosecutor has argued that this may have contributed to the client’s acquittal.

That the lawyer from West Sweden would have been involved was discovered when the police gained access to encrypted chats from Encrochat.

Convicted in the district court

The district court sentenced the lawyer in June to a suspended sentence and daily fines for aggravated protection of a criminal. But the Court of Appeal now acquits the lawyer. The Court of Appeal states that the lawyer is the one who provided information between the suspects, but does not consider that his participation is such that he should be convicted of a crime. They state that there is room for other explanations and that the evidence in chats is not sufficient.

The lawyer has chosen to remain silent in court with reference to the duty of confidentiality.
