Currently, Title 42 applies to citizens of Mexico, Guatemala, Honduras, El Salvador, Venezuela, Nicaragua, Cuba, and Haiti, who, upon crossing the border, are expelled to the Mexican borders, although on some occasions they are deported to their countries according to with the number of arrests or the conditions in which they were found.

The rest of the nationalities are subject to Title 8, through which they can be deported to their country of origin, as is also the case with Ecuadorians and Colombians, according to their own testimonies.
