Mexico City.- The magistrates of the Superior Chamber of the Federal Electoral Tribunal confirmed electoral violations by the Head of Government of Mexico City, Claudia Sheinbaum, for participating in a press conference in favor of the Morena candidate for the Governor of Tamaulipas, Américo Villarreal .

Unanimously, the magistrates considered that the capital official failed to comply with the principles of impartiality and neutrality that public servants in office must have at all times.

The sentence of the Superior Chamber confirmed a resolution in this sense of the specialized regional chamber that, following a complaint from the PAN, determined that Sheinbaum violated those guiding principles in the state process by attending a press conference during the campaign of the Morenista candidate.

“(The sentence) determined that the Head of Government of Mexico City violated the principles of impartiality and neutrality and generated an undue electoral benefit by participating in a press conference in which the former candidate for Governor of Mexico also participated. Tamaulipas Américo Villarreal, which is why he fined the latter and the parties that nominated him,” the resolution states.

“The specialized chamber() attended and adequately applied the jurisprudential line and the criteria that this Superior Chamber has issued on the protection of the principles of neutrality and impartiality that must govern the actions of people in the public service,” the document indicates.

Adam did not break any law

In another sentence, and contrary to what was demanded by the federal deputy of Movimiento Ciudadano Jorge Álvarez, the magistrates considered that the Secretary of the Interior, Adán Augusto López Hernández, did not infringe any electoral norm when participating in various acts in Jalisco in July 2022 .

The MC deputy denounced a meeting of the official with businessmen held on July 15 and a conference given on the 16th of the same month at the event called Expo Guadalajara, Jalisco, as well as the presence of billboards with the phrase #AdanVa.

“The specialized chamber acts in accordance with the law by exhaustively and fully analyzing the expressions that the federal public servant pronounced during the event and concluding that they did not configure anticipated campaign acts by not accrediting the subjective element that said infraction requires in relation to any electoral process in specific”, states the sentence approved.

It is not the way to denounce electoral officials

In another sentence, the magistrates confirmed the rejection of an appeal filed by the citizen Luis Fernando Trejo Ramírez against national and local electoral councilors and magistrates, as well as the Association of Electoral Courts of the Mexican Republic and the former president of the IFE José Woldenberg .

The appeal against these people, according to data provided by the Court, was filed “for the alleged violation of the guiding principles of the electoral function, due to the alleged promotion, dissemination and active participation in the political event called ” March for Democracy”.

The magistrates confirmed the prior rejection carried out by the Technical Unit for Electoral Litigation of the INE.

“Contrary to what is alleged by the plaintiff, the responsible Unit did rule on the inadmissibility of the special disciplinary procedure against people who exercise the electoral function in the federal entities,” indicates the sentence approved at the proposal of the rapporteur magistrate , Felipe de la Mata.

“And, on the other hand, the considerations of the unit were legally correct, since it has been the opinion of this Court that the special disciplinary procedure is not the way to denounce electoral officials.”
