The federal prosecutor Diego Luciani, and the defense of the Vice President of the Nation, Cristina Fernández de Kirchner, presented the respective appeals to the ruling of the Federal Oral Court 2 (TOF), for the case of the public work known as road cause. The prosecution presented the appeal in a 525-page brief and the defense of Fernández de Kirchner in another of 395 pages.

The prosecution requested an aggravation of the sentence, handed down in the Cause Road, for the crime of illicit association, for which she was acquitted in the trial. While the defense, in charge of the lawyer, Alberto Beraldi, requested that the sentence of six years in prison and perpetual disqualification from holding public office for fraudulent administration be revoked.

The appeals entered almost simultaneously, before the expiration of the term, which operates on Wednesday, April 26 at 9:30 a.m. Appeals will now be channeled to the Criminal Cassation Chamber. For the defense, the sentence handed down against Cristina Fernández de Kirchner in the Cause Road“does not have direct evidence to support it”, and understands that it was based on “a series of circumstances that the magistrates described as evidence.”

The prosecutor, Luciani, stated that “the very serious factual circumstances verified by the Court, are adjusted, without much effort, to the requirements of the criminal offense of illicit association.” In the ruling, which was known in December 2022, the judges, Jorge Gorini, Rodrigo Giménez Uriburu and Andrés Basso, They sentenced the vice president along with the businessman, Lázaro Báez, the former Secretary of Public Works, José López, the former head of the National Highway Administration, Nelson Periotti, and five former Santa Cruz officials, to between six and three years in prison.

For the prosecutor who carried out the presentation of the accusation, “the forceful sentence of the TOF, clearly showed the act of corruption most serious in the history of our country, since the advent of democracy”, and added that “he does not understand why he was not convicted of illicit association.” In addition, Luciani asked that the same sentence be applied to Lázaro Báez, López and Perriotti, and that the acquittals of De Vido, Fatala and Garro be revoked”.
