The defendant is 21 years old

The guarantee judge Eduardo Silva Pelossi yesterday rejected a request for release made by the defense of the young man accused of the tragic attack on Lisandro Olmos, which caused the death of three people.

The magistrate’s resolution was based, according to judicial sources, on the procedural dangers represented by the conduct displayed in the moments after the fatal event.

As will be recalled, according to the spokespersons consulted by this newspaper, the 21-year-old defendant, identified as Rony Fernando Aguilera Pizarro, alias “Cholo”, fled the scene of horror, did not notify anyone of what had happened and spent several hours hiding as a fugitive.

In fact, at the request of prosecutor Fernando Padován, the motorist was subject to an arrest warrant and even an international arrest warrant, since, being a foreigner, there was speculation that he might try to cross the border into Bolivia, where he would have relatives.

Although the causes of the accident are the subject of analysis and criminal responsibility in the damaging event has not been proven, for which different expert opinions are being carried out, the victim’s abandonment behavior, according to the investigators’ proposal, is a element that greatly complicates his procedural situation.

Apparently, Aguilera Pizarro does not have a criminal record, but nevertheless, that was not merited by Silva Pelossi.

“I warn that with respect to the named there are clear indications of a flight risk and procedural hindrance, which by the way are not based on a generic and abstract formula, but are based on logical, well-founded and consistent reasoning of the strict assessment of the evidence of the case”, was expressed in the ruling.

“It is necessary to warn as it did in circumstances of converting the apprehension into detention of the cause of the proceedings, that Rony Fernando Aguilera Pizarro was moving at night in a rural area, uninhabited and without lighting, that he himself would not have an authorization card to driving, as well as the conduct assumed immediately after the fact, going on the run in a behavior that implies contempt for human life and respect for the law, which reveals itself in an attitude contrary to the norm, adding to This is what was stated by the Prosecutor in relation to the fact that said attitude constitutes an “extreme that allows sustaining his lack of collaboration with the action of justice and the certain danger of hindering evidence or altering those elements that facilitate the verification or discovery of the true…”, added the resolution.

The victims of this painful traffic incident were Marcos Blas Cardozo (he suffered polytrauma and hypovolemic shock); Alex Caro Ríos (suffered multiple injuries and hypovolemic shock) and Eudalina Caro Ríos (suffered multiple injuries), based on official information.
