On February 10, 2020, Juan Pedro Guarino and Alejo Milanesi left the Dolores prison after three weeks of confinement, after being arrested along with the other eight accused today for the crime of Fernando Báez Sosa. They had been suspected because they had injuries that could be compatible with blows.

Finally, the prosecutor Verónica Zamboni had decided not to charge them for the factwith a request for dismissal: there was no evidence against them to accuse them of the beating or of preventing Fernando’s friends from defending him while he was kicked to death in the skull.

The crime they did not participate in changed their lives. Guarino and Milanesi took shelter for three years. “They cannot go to load gasoline without being looked askance at”assures a source close to them.

Today, Juan Guarino made its reappearance in the courts of Dolores in the trial of his eight friends with whom he traveled from Zárate to Villa Gesell that summer to spend their vacations. He appeared as a witness, summoned by the defense. “There was no specific prior talk between him, Milanesi and the defense. As long as they tell the truth, it is enough ”, assures a key source on the side of the accused.

Upon entering the courts, Guarino assured: “I come to help Justice. Justice for Fernando”.

Guarino, nicknamed “Juampi”, is mentioned 63 times in the elevation to trial of the case presented by prosecutor Zamboni.

It appears, for example, in the filming “obtained from the Marina Supermarket, immediately after the act was committed”, where he is seen with Ciro Pertossi, Luciano Pertossi, Enzo Comelli and Matías Benicelli, while they returned to the house they rented. He is also seen in videos showing rugbiers being kicked out of Le Brique bowling alley. He later got arrested in the raid on the rental house. There, his iPhone 7 was kidnapped.

His hands were swabbed, a DNA sample was taken deposited on an FTA card.

Neverthelessneither the skills or the analysis of cameras allowed linking him to the crime, just like Milanesi. Neither do phones. “Likewise, from the telephone records analyzed from the cell phones of Guarino and Milanesi No elements have been obtained that allow linking them directly to the commission of the act that is foisted on them as primary participants, ”says the case.

“Although he himself is filmed leaving the danceable “Le Brique”, and by Lucas Pertossi from his cell phone when leaving the nightclub (in a restaurant that is next to “Le Brique”), as it would be filmed by private cameras also being intercepted by Infantry, together with some of the other defendants (that only places him in “Le Brique” and in the immediate vicinity, but nothing places him in the direct attack on Fernando)”, affirmed the prosecutor in the elevation to trial.

Then, he expressed: “I believe that, despite this, there are no elements at this point that allow maintaining their situation of uncertainty, This is attentive to the negative result of all the recognitions in round of people developed, and fundamental skills developed. Although only one witness located him in the vicinity of the place, the truth is that no one could recognize him as Fernando’s aggressor or his group of friends. No film record or film expertise, he has recorded him assaulting someone, but only walking ”.

About the injury that led to suspicion, a possible burn on his hand, “Until now, it has not been possible to prove that it is linked and/or related to the fact investigated here.”

These claims were uncontroversial for three years. No witness at trial complicated itor witnesses were summoned that could complicate it.

His statement is scheduled among the first of the day today Monday.
