Attempt to remove the president of the Superior Court of Justice of Morelos fails

This Monday the Superior Court of Justice returned from vacation. During the morning, Gamboa Olea offered a message to restart work. At 4:00 p.m. the plenary session began to determine, among other things, the conformation of the three regional chambers and the auxiliary chamber. However, at 6:30 p.m. the session was interrupted. The version of the presiding magistrate is that a recess was declared at that time.

However, the opposition magistrates decided to continue with the session. Judge Rafael Brito Miranda assured that the recess had not been voted on, so he, in speaking, presented a proposal to dismiss Gamboa Olea. At the request, the aforementioned rose from the table and left the room, followed by two magistrates and a magistrate.

Brito Miranda tried to continue with the session. He asked his eight colleagues present to choose a substitute right there, given the “abandonment of his duties” by the presiding magistrate. At the same time, the senior officer Alberto Emmanuel Espinoza Adán and the general secretary Juana Morales Vázquez, got up from their places and also left the room.

At that moment, Brito Miranda and magistrate Martha Sánchez Osorio tried to stop them. “Senior officer, I ask you to stay because it is his responsibility. At that moment, Brito Miranda asked his colleagues to determine how they would continue the session, noting that there was a notary public in the room who attested to the facts and the “abandonment” of his functions in which the presiding magistrate had fallen. However, there the confusion spread and the magistrates present no longer knew what to do.

Brito Miranda read an extensive document on which he based his petition to request the dismissal of Gamboa Olea, and then nothing. The magistrates rose to their feet and left the room one by one. The attempt to remove the presiding magistrate failed, but it makes clear the fracture of the Judiciary in the entity.

The magistrates who second the current president of the Superior Court of Justice Luis Jorge Gamboa Olea and who left the room with him at 6:30 p.m. are Elda Flores León, Jaime Castera Moreno and María del Carmen Aquino.
