The constitutional reform proposal to limit the actions of the TEPJF already presents some resistance within the Chamber of Deputies, mainly due to the scope that the modifications would have in terms of gender parity and the protection of the electoral political rights of minorities.

This April 10, the San Lázaro Constitutional Points Commission was expected to determine the reform of the Electoral Tribunal of the Federal Judiciary (TEPJF), which seeks to limit its powers in relation to the actions of the Union Congress and the internal life of the parties.

However, for the second time, said meeting was postponed at the request of parliamentary leaders, because the modifications propose changes on affirmative actions related to vulnerable groups and gender parity, which is not endorsed by some legislators, which is why it awoke a discussion that goes beyond the subject of the court.

The deputy Aleida Alavez Ruiz, vice coordinator of Morena in the Chamber of Deputies, stressed that when she learned about the initiative she made some observations, especially in terms of parity and protection of vulnerable groups, since she recognized that the opinion does have some “inconsistencies”. as to how it determines which parties should regulate parity in their internal bodies.

The legislator indicated that these concerns were also raised by other deputies, as well as experts and former legislators.

“It leaves the Chamber the exclusive power to deal with affirmative actions, this really does not take place, because it does not have to be the exclusive power of the Chamber. This faculty seems excessive, there is no place, and I think we could eliminate it, “said the Morenista.

The deputy stressed that among the routes to unlock the opinion, several paths are proposed, among them that an open parliament can be organized; that the reservations on these two issues be addressed or even the presentation of two different opinions to safeguard parity and the rights of vulnerable groups.

While Morena has already agreed to support the opinion, but only in the part that corresponds to the non-interference of the TEPJF in the internal life of the Legislative power.

NGOs defend agenda

For his part, deputy Salvador Caro Cabrera (MC), also a member of the Constitutional Points Commission, pointed out that there is pressure from women’s organizations towards deputies who bring this agenda, since they alert a risk of “treason”, as well as well as by the organizations that supported the marches in favor of the INE, “mainly towards the PAN, which would remain as the great traitor and the suicidal party by approving this type of contention.”

The deputy stressed that his bench has received different groups of society that have shown their resounding rejection, so that in the event that it is approved by congress, MC could dispute the first stage of the process or even take the issue up to the Inter-American Commission on Human Rights (IACHR).

It should be noted that this reform is supported by six of the seven benches that make up the Political Coordination Board, with the exception of MC, and states, among other things, that the parties will establish in their statutory regulations the rules for the appointment of their leaders, without interference from the TEPJF.

While the modification to Article 73 specifies that it will be the power of Congress “to exclusively establish affirmative measures for the access of people belonging to vulnerable groups to the enjoyment and exercise of political-electoral rights, and for compliance with the principle of gender parity” .

The General Council of the National Electoral Institute (INE) unanimously approved the new integration of commissions.
