It was undoubtedly a picture that caused a clear risk to the life of the victim, for which the prosecutor Marcelo Romero requested his capture, which was granted by judge Marcela Garmendia and materialized in the last hours.
“The parents exercised such violent acts towards their baby knowing that there was a certain and concrete possibility of causing his death, assuming said risk and showing absolute indifference towards it, since said result did not materialize for reasons beyond their control,” he said. Romero in the arrest warrant.
It should be noted here that “those who were in custody and in the care of the minor, were unable to explain the reasons for the injuries suffered by their baby, having argued situations that were not consistent with the injuries described, changing their account on several occasions and demonstrating a total lack of interest in the serious state of health of his son ”, it was indicated.
“In effect, the victim’s low age – two months old – excludes any possibility of blows due to wandering or falls resulting from his own mobility.
This allows me to presume the existence of a situation of physical abuse by the parents towards their baby in response to the latter’s demand for basic vital needs such as food, sleep, etc.
This affirmation is essentially based on the state of health that the victim presented, documented in the evidence collected and the considerations and conclusions contained in the medical report, “said the prosecutor.
Regarding the imputed legal qualification, Romero argued that “I understand that the actions of the parents have been carried out with eventual intent, by virtue of the fact that they have carried out acts of abuse and violence on repeated occasions and during the life of the victim , not in a unique or isolated way, but rather denotes a pattern of their behavior, developed in different situations with their child.
Both of them put their baby’s life at risk, knowing his defensive inability due to his young age, which the defendants also used to facilitate their actions, transforming it into an extremely abusive action.
“In this line, two points stand out to take into account: firstly, the danger generated by the defendants and secondly, they were aware of the kind of danger they created by mistreating and physically assaulting their baby, who was under their care. save and care ”, he considered.
Lastly, already in dialogue with this newspaper, prosecutor Romero expressed: “I want to especially highlight the professional commitment of all the staff of the Children’s Hospital of La Plata, Sister María Ludovica, for their concern, involvement and valuable collaboration in this research”.
