The 33-year-old man is sentenced by the Court of Appeal for grossly causing the death of another, reports Hallandsposten.
It was last summer as one 33-year-old man broke in and assaulted the 94-year-old man. The elderly suffered several fractures and damaged lungs. He died of pneumonia in hospital after three weeks.
According to the verdict in the Halmstad district court, it could not be established that it was the 33-year-old’s assault that caused the man’s death.
But the Court of Appeal concludes that there is a connection and writes that the perpetrator should have realized that an older person, due to physical frailty or illness, could be harmed significantly more in connection with the incident than a younger person.
