The reading of the sentence for the crime of Lucio Dupuy, which was scheduled for this Monday, February 13, was postponed, and that day the appeals of the prosecutors, the complaint and the defenders of the accused, Magdalena Espósito Valenti and Abigail, will be heard. Paez.

On February 2, the Santa Rosa Court delivered the verdict in which Magdalena Espósito Valenti and Abigail Páez were found guilty of the murder and sexual abuse of Lucio Dupuy, and announced that they would announce the sentence on February 13.

On that day, the judges decided to declare Lucio’s mother, Magdalena Esposito Valenti, “the material author and criminally responsible for triple qualified homicide by the link, treachery and cruelty.”

In addition, they declared his partner, Abigail Páez, “the material author and criminally responsible for the doubly aggravated homicide for treachery and cruelty in real competition with the crime of sexual abuse, carnal access by anal route executed with a phallic object, aggravated by dealing with the guardian and for having been committed against a minor under 18 years of age”.

What sentence will the mother of Lucio Dupuy and her partner receive

Taking into account the crimes for which they were sentenced, it is most likely that they will receive life imprisonment, the only thing missing was to know how much the aggravating circumstances would add up, something that was going to be known with the reading of the sentence but was postponed due to the appeals of the parties and has no defined date, since it will depend on the decision after the new presentations.

Prosecutors will ask that the mother also be sentenced for outrageous sexual abuse, like the plaintiff lawyer, José Mario Aguerrido, who will also once again argue that Lucio’s murder was a “hate crime” because of his male status.

For her part, the official defender Silvina Blanco, who represents Páez, will insist on questioning part of the autopsy of the doctor Juan Carlos Toulousse and frame the fact in a preterintentional homicide. She will also ask for an acquittal of sexual abuse on the grounds of “reasonable doubt.”

Defender Pablo de Biasi, Esposito’s lawyer, will request the acquittal of his client for the crime of aggravated homicide on the grounds that she was not there at the time of the attack that caused her death. Also, he will look for the fact to be framed in a case of gender violence by Christian Dupuy.
