An Algerian mother has aroused the excitement of many Internet users following the media coverage of her story. Arrived in France about ten years ago, she was the subject of a OQTF (Obligation of Quitter French Territory)which gave rise to a case with many twists and turns.

In a desperate attempt to regularize her situation, she succeeded in having her file reconsidered after several interventions.

Algerian mother threatened with deportation to France: the judge deigns to reconsider his situation

Living in France since 2014, a 41-year-old Algerian woman faced an expulsion order from the authorities. The mother of 2 was staying in the country irregularly after her short-stay visa expired.

Wanting to regularize her situation, the latter had appealed to the prefecture of Val-d’Oise to obtain a certificate of residence in 2019. She comes up against a first refusal from the prefect, who assigns her a OQTF within 30 days in January 2020.

She then goes to the prefecture of Orne to reiterate her request, which also refuses her the document. Worse still, the prefect imposes a new OQTF with a ban on returning to French territory for one year. A house arrest for 1 month and a half is also pronounced against her.

The Caen court decides in the case of expulsion of the mother of the family Algerian

In November 2021, the administrative court of Caen approves the decision of the prefecture of Orne. The Algerian mother contests the judgment, and requests a “provisional residence and work permit” for 15 days at the Nantes court. Its but being to transfer the case to the court of Val-d’Oise. Following which many details come to change the deal during the investigation.

If she says she has no real address in Ornethe judge from Nantes asserts that this is indeed his address “known to the administration”. Another critical detail: the applicant had indicated at the beginning of the case that she was separated from her husband. The latter thus alleged that she had in the meantime “agreed with her husband” to fix the residence of her children with the latter.

The interested party made an appeal and there an unexpected miracle occurred; the French authorities decide to re-examine the elements of the case. “She lives with her spouse, an Algerian national holding a residence certificate valid until 2027, with whom she married in 2014, as well as with two minor children. (..) of which she participates in the upkeep and education” note the magistrates. “the decision obliging him to leave the territory is tainted (…) of a manifest error of assessment as to its consequences on his situation”, the administrative court ends by pronounce re-examination of the file of the person concernedafter several refusals.
