The Complaints and Complaints Commission of the National Electoral Institute (INE) refused to request President Andrés Manuel López Obrador to refrain from requesting the citizen vote in 2024 in favor of the candidates of his party, Morena, to obtain a qualified majority in the Congress of the Union.
By majority decision of the new counselors Rita Bell López and Jorge Montaño, the Complaints and Complaints Commission resolved that the expressions of the president are linked to a possible constitutional reform of the Judiciary and with the integration percentages of a new federal legislature , not so with the local electoral processes that are currently carried out in the State of Mexico and Coahuila.
The president of the Commission, Claudia Zavala Pérez, spoke out against it, saying that the expressions of the head of the federal Executive can cause irreversible damage.
With the vote of López and Montaño, the Commission declared it inadmissible to order the partial withdrawal of the denounced morning conference, since there was no urgency or danger in the delay that justifies the measure, since the federal electoral process will start until the last quarter of this year, coupled with the fact that they are publications made in the past on official pages and social networks, which must be mediated by the will to access and search for specific content.
The Commission also denied the preventive guardianship corresponding to ordering the President of the Republic to refrain from making pronouncements aimed at requesting a vote in favor of or against any political force, as these are future events of uncertain realization.
However, the Commission issued a statement to President López Obrador, so that at all times he adjusts his acts and conduct to the constitutional limits and parameters, stressing the obligation of his position to conduct himself impartially and neutrally in order not to affect in equity in the contest, respecting the times established by law in terms of campaigns and pre-campaigns.
Denies precautionary measures against “corcholatas” of Morena
In another matter, also by a majority of said directors, the Complaints and Complaints Commission of the INE refused to implement precautionary measures against the head of Government of Mexico City, Claudia Sheinbaum; The chancellor Marcelo Ebrard; the Secretary of the Interior, Adán Augusto López and Senator Ricardo Monrealconsidered by President Andrés Manuel López Obrador as his “corcholatas” for 2024.
The Commission heard of seven requests for precautionary measures against the Secretaries of the Interior and Foreign Relations, the Head of Government of Mexico City and two senators of the Republic for early campaign and pre-campaign actsalleged personalized promotion and the probable misuse of public resources within the framework of the Federal Electoral Process (PEF) 2024.
In all cases, the requested precautionary measures were not granted because there was no danger or urgency in the delay that justifies the elimination of the denounced materials, because although it is certain that the 2024 Federal Electoral Process will be held, it will start until last quarter of this year.
In relation to publications on the social networks of Twitter, Facebook, YouTube and Instagram, their withdrawal was denied, since for their consultation the will of the people to access said content must be mediated. Preventive guardianship was denied in all cases, as they dealt with future events of uncertain realization.
Meanwhile, regarding Morena’s complaint against the PRD, for alleged slander and misuse of the advertisement derived from the broadcast of two promotional campaigns on television and radio, in which Morena and her candidate for governor are held responsible for various causes. from the State of Mexico, Delfina Gómez, the Commission denied the removal of the spots because it does not constitute an act of slander, after determining that it is not a specific accusation of a false fact or crime in a clear and unambiguous manner.
Regarding the probable improper use of public resources in this case, it will be the Specialized Chamber of the Electoral Tribunal of the Federal Judiciary (TEPJF) that will analyze the merits of the matter.
