The FGJEM justified its decision not to send the driver to prison by arguing that the crime of which he is accused does not warrant it. Specifically, he pointed out that the criminal act for which he is being investigated is a culpable commission, and therefore“does not warrant informal pretrial detention.”

Jorge Claudio, who for years had been selling tamales, died on December 24 while walking with his tricycle on Morelos avenue, corner of Torre Omega street in Santa María Las Torres. He was struck by a speeding motorist.

The driver, who would have been in drunk statemomentarily lost control of his type car Mini Cooper so it ended up directly impacting the seller who was projected due to the strong blow. After the collision, the motorist he quickly fled the site without helping the manwho died.

Surveillance cameras captured the incident and the video began to circulate on social networks the day it happened, for which the case of Jorge Claudio quickly captured national attention.

Agents from the Cuautitlán Izcalli General Police Station for Citizen Security persecuted, detained and brought Public ministry (MP) to the driver. The FGEM confirmed that Leticia Meráz, who is in charge of the MP, opened the investigation folder for culpable homicide.
