Citizen Marcelo Adrián Alvarez Ojeda had his truck stolen on December 11, 2015. He filed a complaint with the 11th Asunción Police Station. After several years, a prosecutor-police delegation accidentally recovered the property, however, they did not return it.
In the complaint, he mentions that the vehicle that was stolen from him is a Toyota, Hilux model, burgundy color, year 2001, AJV 240 license plate. and He attached to it the documents that legally guarantee his ownership.
Seven years later, on August 11, 2020, prosecutor Alma Zayas, accompanied by commissioner Fabio Sanabria, head of Disarmaderos Control, carried out a search of the property located between the Ykua Karanda’y and Mora Cue de Luque companies. There they rescued a van with the same characteristics as the one denounced by Alvarez Ojeda.
He recounted that, upon learning of the finding of a mobile phone similar to his, he went to the Automotive Department of the National Police. There he verified, as he expressed, that the truck was indeed his, but that they had erased the chassis number.

From this fact, he added, the prosecutor took it upon himself to point out that he could not give him the mobile, until the correspondence is “fully” confirmed. Alvarez said that he gave all the details of the truck, attached the documents, but that even so, his property was not returned to him.
“I asked the Prosecutor’s Office to carry out all the skills to recover my vehicle. However, until now he has not done anything to return what is legally and legitimately due to me.”added the complainant.
Faced with the deaf ears of the person in charge of the file, he emphasized, he now turned to the State Attorney General, Emiliano Rolón, to continue with his recovery attempt.
“I have come to denounce fiscal inaction, with harmful consequences, because more than 7 years ago I have denounced the theft of a van I owned, before the Criminal Prosecutor Unit number 3, neighborhood 2, in charge of the lawyer Carla Rossana Rojas Pereira and to date it has not carried out a single investigation aimed at concluding the case”he stressed.
WHY NOT THE EXPERTISE?
Alvarez Ojeda maintained that he resorted to the Toyotoshi firm, in order to ratify the elements that guarantee his property.
In this sense, he transcribes in his complaint details of what the representative firm issued. “I only ask that they carry out the expertise,” she said.
“When analyzing the response of Prosecutor’s Official Letter No. 281, dated June 24, 2022, sent by the Toyotoshi Firm to the Public Ministry, it can be clearly concluded that only a chemical tempering expertise will solve the dilemma since in said response The company indicates the way in which the identification data of the vehicle will be obtained by indicating:
“… In order to inform you that the factory data of the Toyota brand vehicle, Hilux model, with chassis No. JTFDE626X00056851, can be obtained in the engine compartment by an aluminum plate riveted to the body ( fig. IN-3 A) on which contains the data of Model: model code, year of the vehicle, Engine, Color code of the vehicle, Trim: color code of the upholstery and interior accessory, Trans/ Axle: Transmission and differential code. Plant/Built: assembly plant code, plus the vehicle identification number can be obtained from the front right side of the chassis ( figIN-3 B). The mentioned vehicle, according to our records, corresponds to the 2001 model year. We attach – says the answer – photocopies of the factory data location. Sincerely”. That is, the note explains in detail the places where the identifying data is found. In addition, it tells us that it corresponds to a vehicle that they identify as model year 2001. Therefore, the only way to know with certainty if the vehicle seized in a procedure in the city of Luque is my property.
