He first of May is considered a holidaysince this date commemorates the Labor Day. The consequence of this is that all employed people can take the day off and enjoy the first long weekend of the month, or at least that is what the Federal Labor Law.

However, this brings various doubts to workers who will not be able to rest on Labor Day. One of them is if you pay double, which we will answer here.

If I work on May 1, do I pay double?

In accordance with article 74 of the Federal Labor Law, if you have to work on May 1, Labor Day, you should not be paid double, because, on the contrary, you should be paid triple.

This is because, according to the law, workers who do not rest on the holiday, in this case on May 1, have the right to be paid, in addition to their normal salary, double one for the service provided.

“The workers will be obliged to provide the services and will have the right to be paid, regardless of the salary that corresponds to them for the mandatory rest, a double salary for the service provided. That is to say, they must cover the daily salary plus double”, reads article 74.

What other days are official holidays?

In accordance with article 74 of the Federal Labor Law, the holidays in which the worker has the right to rest are:

  • January 1st
  • On February 6, in commemoration of February 5, the anniversary of the promulgation of the Constitution
  • On March 20, in commemoration of March 21, the birth of Benito Juárez
  • May 1, Labor Day
  • On September 16, the anniversary of the beginning of the Independence of Mexico
  • On November 20, commemorating the start of the Mexican Revolution
  • On December 25, for Christmas.

Why is Labor Day celebrated?

According to the federal government, in Mexico, during the Revolution, the Casa del Obrero Mundial unified several labor organizations, whose affiliates decided to publicly commemorate May 1 as International Labor Day starting in 1913.

Therefore, the commemoration of May 1 became a traditional celebration and recognized as one of the official holidays.
