LEU member states do not have the right to derogate from the European ban, since the end of 2018, on the marketing of seeds treated with neonicotinoids, including in exceptional circumstances, European justice ruled on Thursday.


If a provision allows States to exceptionally authorize pesticides and insecticides containing substances banned in the EU, this “does not allow them to derogate from the regulations expressly aimed at prohibiting the placing on the market and the use of seeds treated using such products”, considers the CJEU, questioned on the case of six derogations granted by Belgium. A total of 11 EU states have adopted such “emergency authorisations”.
