Co-participation: why the Government will not abide by the ruling

The national government will not abide by the ruling of the Supreme Court that restored co-participation funds to the City of Buenos Aires, considering that “it is impossible to comply” and “has a unitary view” of Argentina.

“In an unpublished, incongruous and impossible ruling,” says a statement signed by President Alberto Fernández and 14 governors with whom he met this afternoon at the Casa Rosada to establish a position on the Court’s ruling that obliges the Nation to deliver to the City 2.95% of the mass of co-participating funds.

In addition, the official text specifies: “The President of the Nation has decided to instruct the competent bodies of the National State to challenge the members of the Supreme Court and to present the request for revocation ‘in extremis’ of the precautionary resolution issued”.

The joint document was released six hours after the meeting at the Government House ended, which was attended by 10 provincial leaders and four virtually.

Meanwhile, the letter clarifies that the governors “will instruct the competent authorities of their jurisdictions so that the provincial states request to be considered parties to the file accompanying the recusal of the ministers who signed said precautionary measure and to request the revocation ‘in extremis’ of the same”.

Criticism of the Court

Regarding the ruling, they considered that the Court maintains, in an “unusual” way, that “transferring these millionaire amounts to the CABA does not affect the Argentine provinces”, and they retorted: “This is completely false: these resources would come from the national budget, which is executed in public policies, throughout the territory of the Nation”.

“In a political ruling, facing the electoral year, the Supreme Court intends to subtract resources from all the provinces to give them to the head of government of the CABA. This measure is, under current conditions, impossible to comply with, since Congress National approved the 2023 budget by law without contemplating budget credit for this purpose,” they concluded.

For his part, the governor of Tierra del Fuego, Gustavo Melella, expressed himself through social networks: “After meeting with the President of the Nation, Alberto Fernández, the Governors agreed that the Supreme Court ruling has a unitary view, clearly centralist of the country, which is impossible for the national government to comply with”.

In a post made on his Twitter account, Melella stated that the ruling of the highest court of Justice is “a blow to federalism to politically benefit the City of Buenos Aires, especially its Head of Government (Horacio Rodríguez Larreta) to the detriment of all the Argentine provinces”.

“It is clear that suspending the application of a law of Congress and ordering the Nation to grant the equivalent of 2.95% of co-participating funds, has been a decision to benefit Larreta and harm the provinces and the Nation,” he said.

Sergio Ziliotto also expressed himself through social networks: “Defending Federalism is Defending La Pampa. As we always did, as we always will.”

Larreta will denounce officials who do not comply with the court order

The head of the Buenos Aires government, Horacio Rodríguez Larreta, assured this Friday that Alberto Fernández “wants to break the constitutional order”, after the National Executive Power announced that it will not abide by the ruling of the Supreme Court of Justice on the percentage of co-participation that the President took from the City of Buenos Aires.

Larreta assured that the decision of the national president is of “very high institutional gravity” that “puts the foundations of our democracy at risk.”

“The President of the Nation made the decision not to abide by a ruling of the Supreme Court of Justice and decided to present a challenge against all judges of the Court to prevent them from participating in the process. This is not against the City: it is against the National Constitution, legal security in our country, it is against any possibility of development,” said the Buenos Aires president.

In statements to the press from the headquarters of the City Executive, the PRO leader warned that contempt of the Nation is an act of “very high institutional gravity that puts the foundations of democracy at risk.”

Who is going to trust a country where the decisions of Justice are not respected? Larreta questioned

“Who is going to trust a country where the decisions of the Justice are not respected? Who is going to invest? Who is going to generate work? What can we Argentines expect if the President himself does not comply with the law? This is beyond all imaginable limits”, questioned Rodríguez Larreta.

And he added: “The President decided to break the constitutional order, completely violate the rule of law and attack democracy. Since the return of democracy there is no history of a President not complying with a ruling of the Court.”

In addition, he anticipated that he will file a complaint against officials who do not comply with the judicial order of the highest court.
