Since the Supreme Court of Justice of the Nation (SCJN) removed the first part of the call Plan B of the Electoral Reform promoted by AMLOthe political environment became extremely tense, since both the executive and the majority of the legislature condemned a factious work by the judiciary, consequently, they announced possible actions against it.
The clearest example of this occurred this Wednesday, May 10, during the president’s morning conference Andres Manuel Lopez Obrador (AMLO), since the head of the federal executive condemned that the SCJN invalidate his initiative to modify the political-electoral life of Mexico, consequently, he presented the possibility of modify the judiciary.
In this regard, he argued that there are conservatives who still maintain some interference in the judiciary and in the Supreme Court, for which he theorized that there is “nostalgia for the past, for the anti-democracyby simulation, by impositions, by corruption”, in such a way that the structure must be changed, so that it is the people who define the conformation of the high command in said power.
“That is resolved with the democratic method, that is why I am going to send an initiative to reform the Constitution so that judges, magistrates and ministers are elected, chosen by the people, so that the domination of the domes, and it is the people who really command and govern”
To these statements are added those of hamlet garciadeputy for the National Regeneration Movement (Brunette), who, from the stand of the Permanent Commission, assured that the SCJN violated the Political Constitution of the United Mexican States (CPEUM) by throwing out Plan B, since it ignored what the Article 17 of the same, which obliges the courts to resolve the cases of substance and not by form.
It was for what he pointed out how convenient it would be, in these cases, the application of articles 92 and 93 of the Political Constitution of 1857, where a democratic scheme is promoted in which the citizenry is the one who puts the magistrates of the Cut and his time is limited to six years and not 15, as it is now.
But the support of this idea was not only by a federal deputy from Morena, to this is added the position of Gerardo Fernandez Noronarepresentative for the Labor Party (PT), and Ricardo Monrealpresident of the Political Coordination Board (Jucopo) of the Senate of the Republic, who warned of more measures that can be promoted from the legislature and that would have repercussions on the judiciary.
First, during the session of the Permanent Commission on Tuesday, May 9, Monreal Ávila recalled that there are powers of parliamentary control that the Senate can exercise against the ministers of the Supreme Court, but that it has not wanted to do so, such as the appearance or trial Although he recognized that it is “a delicate issue”, but valid, it should be remembered that impeachment can have as its maximum consequence suspension of office and disqualification from public service for up to 10 years.
On his own, Gerardo Fernández Noroña, also endorsed the sentence against the SCJN and its factious action against President López Obrador and the government of the Fourth Transformation (4T). Therefore, he warned that there will be actions once the next session begins in the legislative branch, since they will go for a trust fund in the judicial branch.
