The Legal Counsel of the Presidency formally asked the Court to resolve, in order of priority, the challenges against the General Law of Social Communication, starting with those registered in 2018 and not the most recent, filed against the so-called “Plan B”.

“The Ministry requested the president of the Supreme Court of Justice of the Nation that, in order of priority and for legal certainty, the high court proceed to resolve first on the constitutionality of the decree that issued the General Law of Social Communication on May 2018 and then the validity of the reform to said standard, approved in December 2022, is analyzed,” he reported.

The legal representative of the federal Executive recalled that, at the beginning of the 2017-2018 electoral process, the PRI and PAN benches in Congress approved said Law, despite the questioning of the National Human Rights Commission and the then Opposition, including Morena and Citizen Movement.

“It was considered that there were defects in the legislative procedure and that some of its provisions, according to the plaintiffs, are not in accordance with the federal Constitution,” he said.

The Ministry warned about the change in the Court’s criteria, since, in 2018, it did not consider that the Social Communication Law had an electoral nature, nor did it grant the requested suspension, as happened now with the so-called “Plan B”.

He also recalled that, to date, the highest court has not issued a final ruling, despite the fact that almost five years have elapsed since the challenge.

“The request of the Legal Counsel of the Federal Executive is with the purpose of avoiding the issuance of contradictory sentences that violate the principles of legal certainty and security to the detriment of the people of Mexico, for which it makes a respectful call to the SCJN to resolve matters of their knowledge without slogans or political distinctions,” he added.
