The attorney general, Margarita Cabello Blanco, it has been declared impeded to hear the review of constitutionality of decree 1085 of 2023which declared a state of emergency in La Guajira.

The notification of the impediment was sent to the Constitutional Court, where Cabello argued that in July 2016, when she was a magistrate of the Civil Cassation Chamber of the Supreme Court of Justice, she signed the ruling of second instance of a guardianship that declared the state of affairs unconstitutional in La Guajira.

The Ombudsman explained that this prior decision could conflict with the decrees issued by the President within the framework of the state of emergency. It is relevant to mention that in 2021, the same Constitutional Court accepted another impediment from Cabello to participate in the follow-up to the ruling of protection of the department.

The role of the attorney in this process
The court stated at that time that “Margarita Cabello played an active role and had a significant degree of participation in the processsince she served as the rapporteur magistrate of the decision that was issued in second instance and that later gave rise to judgment T-302 of 2017″.
Faced with this new impediment, the Constitutional Court must resolve it before August 11, date on which a public hearing is scheduled to discuss the state of emergency in La Guajira.
