The Supreme Court of Justice of the Nation (SCJN) resolved this Thursday, April 20, that the disincorporation of the National Guard of the Ministry of National Defense, to return to the Ministry of Security and Citizen Protection, was postponed to January 1, 2024 to give public agencies time to carry out the necessary adjustments.

With nine votes in favor and two against, those of yasmin esquivel and Arturo Zaldivarthe Plenary approved the proposal of the minister Juan Luis González Alcántara Carrancá to postpone for almost 8 months the return of the GN to civilian command.

On this occasion, Minister Loretta Ortiz Ahlf decided to vote in the direction of the eight ministers who resolved last Tuesday that the secondary law for the secondment of the GN to the Army was in violation of Article 21 of the Constitution.

In this way, the declaration of invalidity of the reform with which the Army took operational and administrative control of this new corporation, will take effect as of next Monday, January 1.

During the session this Thursday, the highest court justified this deadline to allow the budget readjustment of the agencies involved (sedena and the SSPC) to carry out the new transition in an orderly manner.

“In such a way that within this period, the agencies involved will have the necessary time to gradually carry out the readjustment in the administrative, budgetary and operational control of the National Guard, which by mandate of article 21 of the Constitution corresponds to the branch of public security”, exposed the minister speaker.

This proposal also seeks to grant legal certainty to the almost 130,000 elements that make up the GN, an institution that will remain under the jurisdiction of the Secretary of Security and Citizen Protection (SSPC), in charge of the secretary Rosa Icela Rodríguez.
