Supreme Court stops blocking Biden's deportations

WASHINGTON – The Supreme Court The United States announced Friday that it will stop blocking a US government rule that prioritizes the deportation of immigrants who pose the greatest danger to public safety or have been caught at the border.

The justices, by eight votes to one, dismissed an appeal brought by states governed by Republicans against a rule that, according to the government, recognizes that there is not enough money or personnel for the deportations when 11 million people are in the country without legal authorization, in addition to stopping the excess of authority of President Joe Biden.

Louisiana and Texas had argued that federal immigration law requires authorities to detain and deport even those who pose little or no risk.

However, the Court held that the states had no right to sue in this case.

Judge Brett Kavanaugh noted that the executive branch has no choice but to set priorities in law enforcement.

“That’s because the Executive Branch invariably lacks the resources to arrest and prosecute every violator of every law and must constantly react and adjust to the ever-changing needs for the safety and public welfare of the American people,” Kavanaugh wrote.

A September 2021 Department of Homeland Security directive halted the deportations, except in cases of individuals who have committed acts of terrorism, espionage or “serious threats to public security”.

The directive, which corresponds to the presidency of Joe Biden, updated one of the presidency of Donald Trump that ordered the deportation of people who were in the country without authorization and represented a risk to society.

Last year, a federal judge in Texas blocked the guideline’s nationwide application and an appeals court in New Orleans declined to hear the matter.

The only dissent in the Supreme Court ruling came from Justice Samuel Alito, who argued that it unduly favors the president over Congress “and renders states burdened by the effects of massive illegal immigration even more powerless.”
