The holder of the Agreements of the Administrative Court of Oaxaca is arrested for "delaying justice"

According to official sources, Juan Edy García Coronado was arrested this Friday, July 28 at around 07:35 a.m. on Prolongación de Aldama street, in the Los Cántaros subdivision, belonging to Santa María Atzompa.

Elements of the State Investigation Agency (AEI) executed the arrest warrant that was granted by the judge to the Specialized Prosecutor for Combating Corruption.

The crime for which Juan Edy is accused is provided for in article 217 Bis B section VIII of the State Penal Code, and sanctioned in its penultimate paragraph, which establishes that by “maliciously delaying the administration of justice (…) It will impose a prison sentence of three to eight years and a fine of 30 to 1,100 days.”

The defendant was appointed general secretary of TJAO agreements in September 2020, by Manuel Velasco Alcántara, presiding magistrate of the Court of Administrative Justice of the State of Oaxaca.

Vásquez Sagrego recalled the accusations that were constantly made against the Court that on Saturday the 22nd the Congress of Oaxaca dissolved via “fast Track”, because it was allegedly “involved in various accusations of corruption.”

This dissolution of the Court was suspended on Friday the 27th by the Supreme Court of Justice “so that the magistrates of the Court of Administrative Justice of the state of Oaxaca continue in the position that was conferred on them and are not replaced.”

The moditos of the Oaxaca Congress

On Saturday, July 22, 2023, the local Congress decided, via ‘fast track and in less than 20 minutes, to disappear the Court of Administrative Justice of the State of Oaxaca to create another one for Governor Salomón Jara Cruz.

On the same Saturday, the 22nd, the initiative was presented, analyzed, approved, appointed, ratified and integrated into the new court, and published in the Official Gazette of the State Government.

The deposed magistrates appealed to the Supreme Court of Justice of the Nation (SCJN) and this, through its Recess Commission, admitted the constitutional controversy 396/2023 against the decree that reforms the Court of Administrative Justice and suspended the appointment and ratification of new magistrates.

The legal adviser Vásquez Sagrero insists that the decision of the Supreme Court does not affect the new appointments or the functions of the new judicial body, because “you cannot suspend something that has already been completed, as it is a general principle of law.”
