“I clearly remember having consulted Diego Cesar Santilli and Uriburu”confessed Elias Ezequiel Nuñes Pinheiro the 27th of March. He was referring to the PRO candidate for governor and one of the three judges who sentenced Vice President Cristina Kirchner in the Highway case, Rodrigo Giménez Uriburu. The young man testified at that moment before a Buenos Aires prosecutor for the hacking of the former Buenos Aires Minister of Security Marcelo D’Alessandro. That cause was suspended while it is defined if it lands in Comodoro Py. In parallel, federal judge María Servini decided to unarchive a complaint by Diego Santilli and summoned the hacker for this Monday at noon. Santilli was hacked on October 14 but the cause started on November 2. The PRO deputy was in Mar del Plata when he realized that his line had been stolen for a few hours. From the beginning he downplayed it because three weeks before, by chance, he had deleted all the messages. “She sat on top of the phone and broke the screen. When she changed the device, she could not make the backup copy and only recovered her photos, ”said a source close to her at the time.

Servini delegated the investigation to prosecutor Federico Delgado, who reached out to a SIM card vendor in Misiones, Junior Gularte. In a short time the name of Nuñes Pinheiro appeared. The two testified as witnesses, via zoom, but did not provide details. Far from confessing, the young hacker assured that he had sold the SIM investigated by the Justice.

But that summons had consequences. The young man would tell later that he got scared, set his phone on fire and threw it into the Paraná River.

Although less than two months had passed, on December 22, with an opinion from the prosecutor, Servini decided to archive the file. Santilli’s lawyers decided not to appeal and responded with a new submission asking for three specific measures of proof.

On March 14, the court ordered the file again. Once again, the complaint in charge of Adrián Maloneay, claimed a pending measure: that an official letter be sent to all the telephone companies to determine if there was any other line in the name of Santilli. In that presentation, the lawyer mentioned the case of the president of the Supreme Court, Horacio Rosatti, who had already denounced the appearance of four telephone lines in his name. Without a specific answer, Santilli’s defense decided to notify each of the companies by document letter. “No emphasis on research”, they said close to the deputy.

At that point, the young missionary had already confessed that he had hacked D’Alessandro and other influential people in politics and the judiciary. He gave the name of Santilli and Giménez Uriburu.

Nuñes Pinheiro used a technique called SIM swapwhich consists of taking control of a telephone line from another device, without the consent of its owner.

In the case of D’Alessandro, he interacted, via SMS, with the Movistar platform to respond to three personal data: the line number, the document number of the owner of that line, and the ID number. To obtain these data, he used a fake profile of Nosis in the name of “Nicanor Moreno Crotto”, a former official who worked alongside Marcos Peña.

According to his court statements, the person who hired him identified himself as “eljuanxd” and always paid him in advance with cryptocurrencies. Buenos Aires prosecutor Daniela Dupuy managed to detect the transfers but she failed to identify the mysterious Telegram user.

Nuñes Pinheiro is closely watched by a sector of federal politics and justice. Due to his situation, the Buenos Aires judge Araceli Martínez ordered in mid-April that he be kept in custody. The measure took a long time to become effective. The delegation of the Federal Police of Misiones would have argued that it did not have personal and just a few days ago, Judge Eldorado Nuria Allou ordered the local Police to take over. “Custody is at the personal address, but it becomes complicated because he is traveling all the time,” explained a source from Misiones, where attention is focused on this Sunday’s elections.

Nuñes Pinheiro will meet tomorrow with his lawyers to plan a defense strategy. In principle he would not refuse to testify. If he confesses to the hack to Santilli again, there are several possible scenarios. Judge Servini could accuse him of false testimony and send the case to another court. He could also retain the cause while the conflict of competence between so many causes is defined. In Courts it is not ruled out that the hacker ends up arrested for the scandal. Prosecutor Daniela Dupuy had already requested this measure in March, but Judge Martínez refused and only authorized searches in Misiones.
