The SCJN admits a challenge against the "Godoy Law"

MEXICO CITY (apro).- The Supreme Court of Justice of the Nation (SCJN) admitted for processing the action of unconstitutionality processed by opposition legislators against the reforms approved by the Congress of Mexico City, to extend the position of Ernestina Godoy at the head of the capital’s Attorney General’s Office, for four more years.

The lawsuit was admitted for processing by Minister Juan Luis González Alcántara Carrancá, who denied suspending the entry into force of the reform to the Organic Law of the FGJCDMX, which establishes the process for the ratification of the prosecutor.

Consequently, in the following months the minister must analyze the demand and whether or not the reform conforms to the Political Constitution of the United Mexican States, to present a resolution project.

To resolve this matter, the Court does not have a fixed term, so it may take more than a year to define whether Prosecutor Godoy will be able to remain in office for longer, arguing that an administrative restructuring within the Prosecutor’s Office is required. .

Consequently, the ratification process of the head of the FGJCDMX was modified to make it simpler and with fewer stages, since the Citizen Council will evaluate Godoy’s performance and issue its opinion, later the head of Government will issue its point of view on the Board evaluation.
