In the last session of the year, the ruling party and the opposition approved this Thursday an ordinance that regulates the activity of courier and food delivery in the city and that provides for the creation of a single registry in which those who carry out the activity, both service providers and workers, must be recorded.

The project, presented by the block Together for Change and accompanied by the front of all and by the union that brings together the delivery people, creates a “single registry” in which both the delivery drivers and the platforms that provide the urban delivery and messaging service must register, with the objective of “giving greater transparency” to the system that is used by thousands of people from La Plata on a daily basis. It also seeks to help combat insecurity by requiring those who use a motorcycle to work the property title or right to use the vehicle.

Article 2 creates the Single Registry of Distributors, Digital Platform Operators and Service Providers of food substances, and establishes that workers must register as a condition prior to the development of the activity. Gastronomic establishments or commercial premises that do not carry out urban messaging and/or home delivery as their main activity, as well as the employees of these premises, will be exempt from registration.

The distributors must meet the following requirements to register: have documentation issued by the service provider, establish an electronic address and not have traffic violations for the renewal of the qualifications. Meanwhile, to work you must use a regulatory case, clothing with reflective bands and a backpack with an identification number. In case of using a motorcycle, the project establishes that they must prove the title of the vehicle or the right to use it if it is not owned by them, and prove civil liability insurance against third parties and personal accident insurance.

The operators must present a contract or social statute registered in the Public Registry of Commerce or in the General Inspection of Justice; certify registration before the Federal Agency of Public Revenues (AFIP) and before the Platense Collection Agency (APR) if applicable and constitute an electronic address. They must also have telephone lines or service channels for users, delivery men and messengers. Those who meet all the requirements will obtain authorization, which will be valid for one year for service providers and operators and two years for delivery drivers.

When presenting the project, the Councilor for Juntos, Romina Cayon, He maintained that it is “a first step” to regulate the activity and stressed that there is a similar ordinance in the Autonomous City of Buenos Aires and that it was agreed with the union that currently brings together the delivery men. “It is a first step, we would be almost pioneers. The project establishes that, without prejudice to the sanctions of “warning, suspension of authorization or impossibility of obtaining authorization”, the competent judge may also impose economic sanctions.

The digital platform operator that encourages or punishes or sets guidelines that encourage non-compliance with traffic regulations (to arrive faster with food) will be sanctioned with a fine of 10 to 500 modules.
