Many are the cases of students, but also of families threatened with expulsion in France. Indeed, in recent times, more and more foreign nationals are receiving obligations to leave French territory and many Algerian families are going through the ordeal because of this decision.

Among the latter, Amina and Hicham B that they will have to leave the country, accompanied by their five daughters, aged between 6 months and 11 years. If the family had left Algeria in 2015, it was to look after their eldest daughter, who was three years old at the time.

In the Hauts-de-Seine, the Algerian parents of five children born in France threatened with expulsion

Indeed, the decision to give up their life in Algeria dates back to 2015, the two Algerian parents took this decision to treat their child suffering from a serious heart defect, otherwise known as tetralogy of Fallot. A complex heart pathology that requires not only care from birth, but also surgery.

For this Algerian family, traveling to France was a matter of survival. Because their daughter kept having anoxic discomfort. As soon as they arrived in France, the little girl had an operation, but the doctor forbade the family to return to Algeria. And this, given that the state of health of the girl was still critical and risks having complications.

This is how the family decided to stay in France. Since then, especially in 2017, the father of the family has managed to obtain a work permit and be hired as a sorting agent at Paris CDG airport. However, in 2020, the situation of this Algerian family began to get complicated. Their temporary residence permit in France is about to expire and the application for a residence permit has been refused by the Hauts-de-Seine prefecture. In March 2023, the family received an OQTF associated with a ban on returning to French territory.

Returning to Algeria means for Amina and Hichem B to take risks regarding the state of health of their daughter, who is now 11 years old. Indeed, the child’s attending physician, the cardiopediatrician at the Robert-Debré University Hospital, has certified that his state of health requires treatment. But also, a follow-up in a highly specialized center and the return to Algeria would involve a vital risk.

Since receiving this OQTF, the family has been living the ordeal on a daily basis. A decision that the latter does not understand, because according to the circular of Valls, the two Algerian parents are eligible to stay in France. For its part, the Hauts-de-Seine prefecture, contacted by BFMTV, justified its refusal to renew the residence permit by several “factual elements”. In particular, the irregular entry of the family into French territory, the opinion of the Ofii on the state of health of the girl which did not prevent her from traveling to her country of origin.

Reasons denied by Hicham, who claims to have traveled to France through a short-stay visa, then stayed in the country thanks to a temporary residence permit for a sick child, which has been renewed several times.

Solidarity is organized in favor of this Algerian family

To try to find a solution to their case, which turns out to be quite complex, Amina and Hicham have hired a lawyer. For the latter, the circular of Valls is quite clear and an exceptional admission to stay could be granted. The family lawyer denounces a “subjective assessment of the law” on the part of the prefecture in question.

A request for appeal was made by the lawyer to request the cancellation of this decision. Fortunately, the Algerian family received the support and solidarity of several people. Including that of the RESF which recalls that the last three daughters of this Algerian couple were born in France and their future is uncertain.

For her part, the president of the association of parents of pupils, of the school where the girls of this Algerian family are educated, launched a petition which collected 341 signatures. And this, to allow this family to stay in France and care for their child in the country.
