The Municipality formalized legal actions against a developer and a construction company that in different urban projects had illegally occupied the public space reserved for the layout of streets.

As reported, The action was directed against Grupo Urbaninza SA and the Building construction company, which carry out the urbanization projects “Las Carolinas”, at 471 between 138 and 141, and “San Joaquín”, located at 484 between 139 and 141. In that same report it was indicated that a mega operation is being prepared for this Wednesday.

After inspecting the property and intimidating those responsible to reverse the situation, the Commune -with the intervention of the Misdemeanors Justice- will remove a wire fence located on Calle 471 from 138 to 141, since it represents the illegal usurpation of a public street.

Inspectors from the Municipality’s Urban Planning Secretariat verified the location of the wire perimeter on the property that, according to the survey plan, occupied a street drawn on the city plan. For this reason, they summoned those responsible for the illegal action to remove it. After the stipulated 48 hours, The agents confirmed that the company did not reverse the situation, therefore, in accordance with article 103 of Ordinance 10,681, the Misdemeanor Court intervened to remove the aforementioned wire fence and free the street for public use..

The person in charge of the Planning area, Maria Bottadetailed that “471 street between 138 and 141 was arbitrarily fencedwithout a report or municipal permit and in full knowledge of being occupying a public space, in breach of article 250 of Ordinance 10,703″. He added that “the Julio Cesar Chaparroa representative of Building SA, to specify the procedure for opening the artery, but he never did.”

In this context, and in accordance with current regulations, the Municipality will carry out an extensive operation on the site this Wednesday in order to remove the wire fence and, in parallel, will formalize the corresponding complaints and legal actions. The procedure will be developed jointly between the areas of Planning, Citizen Control, the Community, Legal and Technical Delegation and the Justice of Misdemeanors.

INTIMATION IN THE “SAN JOAQUIN”

The Commune also intimidated the Urbaninza SA Group corresponding to the “San Joaquín” neighborhood, located at 484 between 139 and 141, for the illegal occupation of public streets. According to what was stated by the Municipal control agencies, “it was detected that streets 480 between 139 and 141; 140 between 479 and 480; and 141 between 479 and 480 are closed to public use and that it is not possible to access the themselves due to the placement of wire fences”.

Faced with this situation, those responsible for the aforementioned urbanization project were also intimidated, who were urged to immediately release the respective streets and remove the wire fence.

“These roads were closed for the private use of the neighborhood, causing a lack of connectivity in the area,” local authorities stated; and they advanced that “if they do not comply with the opening and are not released into the public space, they will proceed with the steps established by the current codes and the Misdemeanor Justice, once the submission deadline has been completed.”

The figures of the occupation and obstruction of public space are sanctioned in the Misdemeanor Code (Ordinance 6,147) and constitute violations of articles 129 and 138 of Ordinance 6,147, which establish fines of between 10 and 500 modules, in addition to other provisions contained in the Code of Offenses of the province of Buenos Aires.
