Will Trump be able to run in the 2024 presidential election?

On November 16, 2022, Trump made his official announcement of running for re-election, and in the middle of his career he has been indicted, two and a half years after Joe Biden came to office. White House.

The former president faces four trials, two civil, two criminal ones that already have a date, and two investigations that could lead to new trials. It is about the investigation into the riots on January 6, 2021 at the Capitol, and the alleged electoral interference in Georgia in 2020.

One of the criminal trials is dated May 20, 2024, it is related to the classified documents at the end of his term, he faces 37 charges. For March 25, 2024, a criminal trial is scheduled in Manhattan for alleged “secret payments” to porn actress Stormy Daniels, during the 2016 election campaign, to conceal an alleged sexual encounter.

He also faces two civil trials: One, in New York for alleged fraud along with three of his children, which would be scheduled for October 2, 2023; and the second, in Manhattan for alleged defamation against E. Jean Carroll, who accuses him of an alleged assault in a store dressing room that would have occurred in 1996. The last trial is scheduled for January 15, 2024.

For the lawyer Isadora Velásquez, a Democratic analyst, she assures that the processes that the ex-president faces do not hinder him from being a presidential candidate. “He can have 1,000 investigations open at the same time and still run for president. What could stop his candidacy could be a guilty verdict or taking some guilt,” she asserted.

In case of being found guilty in the civil trial in New York, promoted by the Democratic prosecutor Letitia James, Velásquez maintains that Trump could continue as a candidate. The panorama changes, when it comes to trials with federal charges that are a little more serious, he warns and gave as an example the case of January 6, 2021, currently under investigation and that according to Trump will be accused.

For lawyer Lorenzo Palomares, a Republican analyst, he maintains that, although there is a trial date, Trump “could request an extension based on certain cases that exist (background), but I don’t want to anticipate what the former president’s lawyers are going to do, but he has affirmative defenses there, a discovery of evidence that has to continue,” he said without going into details.

Palomares affirmed that “as long as he does not have a final and firm sentence, he could continue his campaign and participate in the elections. Despite the series of accusations that the former president faces, the law grants resources to appeal, ”he explained.

In allusion to the case of the classified documents, the lawyer and former state prosecutor, Sabino Jauregui, interviewed by the journalist Juan Manuel Cao of América Tevé, said he was very sure that the Trump team was going to try to extend the case because there is a hearing preliminary on May 14, where there will be presentation of arguments and motions.

“I bet anything that his team is going to have a problem with the evidence, the petitions, motions and there they are going to try to postpone the trial.” Something that ensures that it will depend on the legal assessment made by the judge who hears the case.

win the presidency

Meanwhile, the Democratic analyst said that if Trump is found guilty before the election, one of the many charges he faces may close the door on him to continue his aspirations to return to the White House. “That will depend on the position, and time is of the essence,” she says. “Having a criminal record doesn’t necessarily close the door for you to run for president,” she said.

“He can be president, even if he loses the trial, if he wins the elections, the question is that he himself could forgive himself. There are legal experts who are arguing just that right now. We are in a place we have never been before, the law is not designed for this, which has no precedent, and we are going to see how it proceeds,” said former prosecutor Jauregui.

For Velásquez, if Trump wins the presidency, it is understood that he will forgive himself. If this is not resolved and he wins, practically (the cases) are eliminated, we forget about this and he would not continue, but he would have to win for that to happen, ”he specified.

According to Velásquez, times are decisive from now on for Trump.

“Technically there could be a sentence before the November 2024 elections, a trial could take a month, but we have already seen the previous one that they are going to ask for more time, it is what is assumed will happen, but the trial can end. before the November elections.

Biden, the candidate

Velásquez assured that the Democratic candidate will indisputably be President Biden, who will surely face Trump.

“The message from the polls is not new and the Democratic Party has said that it will be behind President Biden, although people like Robert Kennedy Jr. have shown this third option and there are even parties that we cannot say are parties, but have come out as alternatives, the Democratic Party has remained steadfast in backing President Biden beyond the polls. If we continue as we are, I dare to say that it is the joke of ‘Guatemala and Guatemala worse’, of the two poor options it will be the one we choose, but to eliminate what is going to happen it would have to be a conviction against Trump, before the elections and that the Democratic Party would go to primaries, which is highly unlikely.

Polls favor Trump

The lawyer Palomares added that the Democrats are shooting everywhere, he assures that Trump has become a target of the Democratic Party and the Department of Justice who do not want to see him participate in the elections, that is widely obvious, the lawyer believes.

The accusations against the former president have not had a negative impact so far, he leads among the presidential candidates in the Republican party, the closest behind him is the governor of Florida, Ron DeSantis, with an average difference of 20 points to Trump’s favour.

The latest polls continue to place Trump as the favorite for the Republican nomination. Yahoo News reveals 48% support for Trump and 23% for Governor DeSantis; while the one carried out by Reuters / Ipsos indicates a 47% approval in favor of Trump and 19% for DeSantis.

“This is a gift to Trump, for the purpose of the campaign because while the trial is taking place in May, he will be on his campaign and every day he will be in the news and the press. The face that is going to be seen is that of Trump, the arguments that are going to be seen in Court are going to be those of Trump,” Jauregui stressed.

Palomares assures that every time Trump is attacked, he rises in the polls and receives more financial support.

“Politically speaking, it is clear that they are attacking him and the effect obtained is that they are making him more popular in the polls and he has gained more strength. I have seen polls within the party of up to 73% approval, although they are not published, the effects that the Democrats have tried to achieve to disable him have been adverse and Trump has come out stronger politically speaking, ”he said.

The foregoing is due, Palomares explained, to the differential treatment that Trump receives with that of Hunter Biden, accused of alleged corruption. “That is showing the world and American citizens how double-faced we are as a country.”

The Republican analyst called the fact ample evidence that the Biden administration and the attorney general (Merrick Garland) have a double standard and are treating Hunter Biden very differently.
