A scientific test requested by the 2nd Sentencing Court of Santa Tecla saved Pablo Elmer HM from prison, who was arrested, charged and prosecuted for the crime of rape of a minor or incapable.
According to the indictment, in June 2021, a 14-year-old girl went to her father’s house in San Pablo Tacachico, in La Libertad, to participate in a lunch and welcome a relative who had come from the United States (uncle political).
The uncle-in-law, his daughter and the victim went to pick lemons. On the way, the now defendant asked his daughter to return to help with the preparations. According to her niece, when they were left alone, her uncle raped her in a bush.
In the report of the complaint, the victim indicated that after the rape she became pregnant. However, a scientific DNA analysis revealed that the defendant is not the father of the child and that the dates of the day of the alleged rape and the birth do not coincide, therefore, given the inconsistencies in the evidence, he was declared innocent.
