Those who work rotating shifts or overtime will be exempt from the tax. How much will the basic cost be and when will a bonus be added?

At the same time that the demands for the payment of the Income Tax grow, the Federation of Argentine Workers of the Oilseed Industrial Complex, Cotton Ginners and Allied Workers of the Republic (FTCIODyARA) and the Union of Workers and Oil Employees of San Lorenzo (SOEA) achieved a decisive benefit consisting of the exemption from paying extras for those who work rotating shifts or the so-called “fourth shift”. According to trade union sources, This impacted 30 percent of the basic wages of workers in the activity and now will mean “a significant improvement in the purchasing power” of the so-called “oilers.”
The representatives of both union organizations agreed with the directors of the Chamber of the Oil Industry (CIARA) and the Ministry of Economy -through its National Directorate of Taxes- the disposition of the changes regarding the payment of Profits on the additional sums that are paid in terms of rotating shifts. Now it remains for the authorities of the Federal Administration of Public Revenues (AFIP) to enable the modality, which is taken for granted and it will begin to apply almost immediately.
It is worth remembering that last December the Federation and the Union achieved a salary recomposition within the framework of the reopening of the parity, which brought the basic to 319,185 pesos as of January 1 and a bonus of 210,000 pesos will be settled between February and March. The parties established that they will sit down again at the discussion table in July 2023, although trade union sources admitted that if the inflationary process does not slow down, they will raise the need for an adjustment.
Guild of oilers: claim and negotiation since last October
Regarding this new benefit, the General Secretary of the Oil Federation, Daniel Yofra, told iProfessional that “this is due to the joint effort of the trade union organizations” and noted: “Since last October we have been holding meetings with AFIP officials and the Ministry of Economy, to whom the problem of unfair and distorting impact was explained to them that the current tax scheme has on wages in our sector”.
Likewise, they informed that under resolution NO-2022-139020523-APN-DNI#MEC of the Ministry of Economy, it was established that “the additional ones for rotating shift, (Fourth Shift), are exempt from the payment of Profits in accordance with current regulations. also clarified that “Not only the overtime on weekends of those who perform tasks from Monday to Friday are exempt (up to the current limit), but also those worked in the weekly breaks of the staff of the fourth rotating shift.”
Yofra stressed that “it is a significant increase in the income of the workers of both Agreements, since this additional which today is 30 percent of basic wages It will all go into the pocket of the oiler/oiler, and will not be affected by the withholdings”.
A good part of the oil workers’ union will benefit from the Earnings exemption.
How the $210,000 bonus for oil workers will be settled
Regarding the bonus of 210,000 pesos, the unions and the directors of the Chamber of the Oil Industry (CIARA), the Industrial Chamber of Vegetable Oils of Córdoba (CIAVEC) and the Argentine Chamber of Biofuels (CARBIO) established that It will be paid between February and March. In the salary review of the collective labor agreement 420/05, a basic of 294,284 pesos was set plus 24,900 pesos of non-remunerative amount that will be incorporated into the salary from April.
Yofra reported that the bonus “is an extraordinary payment that has been established since 2010” and recalled that in the last agreement “We set December as the date to analyze the evolution of inflation and the impact on wages; obviously we will continue to see the numbers of the cost of living and if any adjustment has to be made, we will raise it with the business chambers”.
He expressed that “workers are the most affected by this inflationary situation because it affects the purchasing power of wages.” And he added: “That is why we carry out an evaluation every month on how the salary is affected.”
