Two years after the disappearance of a 50-year-old from Lower Saxony, the murder conviction against his best friend is final. The Federal Court of Justice (BGH) confirmed the judgment of the Braunschweig Regional Court of May 2022, as announced on Thursday in Karlsruhe. The district court had sentenced the accused, a federal police officer, to life imprisonment. It was considered proven that he had killed his friend. His body was never found. (Az. 6 StR 546/22)

In the ZDF program “Aktenzeichen XY … unsolved” the population was asked to help find the man, but this was unsuccessful. The Braunschweig regional court based its judgment on circumstantial evidence – including the fact that the missing person’s blood had been found in the defendant’s car.

Cause was an affair

There were also other indications, as the BGH announced. Some time before the crime, the defendant had a mobile phone connection set up on presentation of someone else’s ID card, which he later used to contact his friend.

According to the verdict, he had an affair with his wife and wanted to have a steady relationship with her. Since the couple did not separate, he killed the 50-year-old and hid his body. Against the Braunschweig judgment, he turned to the BGH, which reviewed it. Since the BGH did not find any legal errors, the judgment became final. (AFP)
