The case Ficrea keep going. Now, the parties that carry out the commercial bankruptcy of this company, which functioned as a popular financial company (sofipo), have approved hiring the firm Alanís Figueroa Abogados Asociados to recover assets insured by the Attorney General of the Republic (FGR), which have a value close to 130 million pesos.
According to a report from the controller in this process, Fernando González Santillana, the office will be charged under the Cuota Litis modality, that is, it only authorizes the office, or has the right to collect, against the positive results obtained from its job.
“The professional (office) will assume and absorb all the operating expenses for the recovery, the foregoing among the most relevant that the judge (Judge Virginia Gutiérrez Cisneros) resolved,” can be read in a letter addressed to the little more than 3,600 creditors of this process, most of which are affected by the alleged fraud of the former owner of said sofipo Rafael Olvera Amezcua.
This agreement is one more attempt to recover assets so that they can be monetized for the benefit of said firm’s creditors. From 2015 to date, around 1,400 million pesos have been dispersed to those affected, that is, around 20% of the total debt recognized in this process, close to 6,500 million pesos.
According to what was reported by the auditor González Santillana, among the assets that will be fought for their recovery, and that are insured by the FGR, the following stand out:
- Furniture
- Estate
- bank accounts
- Artworks
In the context of the agreement, the office would charge 20% of what was recognized and recovered in favor of the Ficrea stream, according to the contract that must be reviewed and approved by Judge Gutiérrez Cisneros.
Although the FGR, since it was the Attorney General of the Republic, has been active in seizing assets that were allegedly acquired with Ficrea resources, as well as those of their savers, the chaos comes when they are transferred to the commercial bankruptcy for its monetization.

According to the document where the judge gives the endorsement for the signing of the contract between the syndicate, headed by Miguel Escamilla Villa, and the firm Alanís Figueroa Abogados Asociados, the latter has the ideal profile to carry out the recovery of these assets .
“Said office at its headquarters in the United States of America, completed the recovery of various assets in that country, which were incorporated into the bankruptcy estate and based on this, it has been possible to continue making payments to the recognized creditors in the bankruptcy company in which it acts”, can be read in the document in the possession of this medium, dated April 18.
The document specifies that the work of said office will focus on recovering assets that have been seized by the ministerial authority.
In the context of said guarantee, the auditor Javier Paz together with the lawyer Jesús Ángel Guerra Méndez, partner of the Guerra González law firm and who was the one who requested the commercial bankruptcy of this firm, expressed their disagreement with said agreement, due to the fact that the The trustee did not publicly offer this service and thus reduce the percentage of the commission provided for the firm Alanís Figueroa Abogados Asociados, which was initially expected to be 30 percent.
However, the auditors González Santillana and Verónica Meléndez Valdez, an official of the National Commission for the Protection and Defense of Users of Financial Services, expressed their agreement with the agreement, with the limitation that the fees that are authorized are 20 %, and not the 30% initially requested.
With all the information requested by the trial judge, it was approved that the contract be signed between the syndicate and the firm Alanís Figueroa Abogados Asociados.
This office was one of those hired by the Financial Intelligence Unit, when Santiago Nieto was in charge, in order to recover assets on the Mexican side, which the former Secretary of Public Security, Genaro García Luna, allegedly acquired with public resources.
