While the December 25th, most families take advantage of the Christmas holiday to spend it with their families, a good group of people must work, to fill positions in services in essential sectors or others related to entertainment and restaurants. People from the private sector who agree with their employers to work on the December 25 holiday, without subsequent rest, should receive triple your daily salary.

Private sector workers who agree with their employers to work on the holidays of December 25, 2021 and January 1, 2022, without subsequent rest, must receive triple their daily salary for each holiday.

The Chamber of Commerce of Lima (CCL) explained last year that the national holidays of December 25 and January 1 are not working, but such days are paid to workers. For them, if those days are worked, the following cases can occur:

– Work on holidays: Private sector workers who agree with their employers to work on holidays (December 25 and January 1), without subsequent rest, must receive for each holiday triple their daily salary corresponding to: one for the holiday, another for the work done and a third remuneration for having worked on a holiday, without subsequent substitute rest.

– Work on a holiday with subsequent rest: If it is agreed to work on a holiday (December 25 and January 1), with a subsequent substitute rest, the workers will receive double daily remuneration, one for the holiday and another for the work performed.

remote work: Regarding the people who perform services through remote work, from their homes, likewise, they do not work the aforementioned holidays, although they receive their respective remuneration. In the case of agreeing with their employer that they are going to work on the holiday, they will also be entitled to triple payment of their daily remuneration, as long as there is no subsequent substitute agreement.

– Work on holidays with subsequent rest: Meanwhile, workers who agree with their employers to work on holidays, with subsequent restthey must establish how the holiday worked will be compensated later, with other working days in the company.

It should be noted that next Monday December 26 will be the day nonworking for public sector workerswhich, added to Christmas on Sunday the 25th, will allow for a long weekend.

In accordance with the provisions of the Supreme Decree 033-2022-PCMpreviously published in the Official Gazette El Peruano, the hours stopped working during December 26 will be compensated in the ten days immediately afteror at the time established by the head of each public entity, according to their needs.

In the case of private sector, the norm clarifies that the work centers may take advantage of this non-working day, prior agreement between the employer and its workers, who must establish the way in which the recovery of the hours left from work will be made effective. If there is no agreement, the employer will decide.

Entities and private companies that perform sanitary and health services, cleaning and sanitation, electricity, water, drainage, gas and fuel, burials, communications and telecommunications, transportation, ports, airports, security, custody, surveillance, and transfer of valuables and sale of groceries and food; they are empowered to determine the jobs that are excluded from the non-working day.

The Minister of Economy and Finance, Alex Contrerasindicated on Friday, December 23 that in any case the additional 200 soles will be paid to complete the 500 soles of bonus promised to public workerstaking into account that they already received 300 soles initially programmed.

“This will be given additional payment of 200 soles and what has been received are the 300 soles that were initially programmed,” Contreras said in an interview with TV Peru News.

Alex Contreras clarified that in order to pay the 200 additional soles you need a legal frameworkwhich in principle should be done with the approval of a law in the National Parliament, but there is also the possibility of doing so with an emergency decree.
