Case

At the heart of recurring controversies, influencers are regularly accused of promoting dubious or banned products in France. Among the scams being the subject of legal investigations, the diffusion of advice in sports betting, or in financial investments. Some personalities also engage in dropshipping, a practice of ordering products at very low prices online, then reselling them to subscribers by promising them a fictitious reduction. Sometimes with several million subscribers, these influencers are essentially remunerated by product placement, which they are accused of not always declaring to their subscribers. Their entourage, starting with influencer agencies, is also singled out. For the victims of crooked influencers, it is sometimes difficult to enforce their rights in court, with personalities often living abroad. Popularized by various reality TV shows, the influencers in question have rarely been the subject of sanctions by the platforms. Some of them, however, were banned from Snapchat and then Instagram in early 2023.
