The tenant of the apartment, mother of two, had pocketed 250 euros for five days in the summer of 2021.
Made aware of the facts, the social landlord, FDI Habitat, chose to initiate legal proceedings. The court then pronounced in November the termination of the lease and the eviction which will be effective at the end of the winter break on March 31. The tenant is also ordered to pay the legal costs (1650 euros) and the bailiff’s costs.
“All the contracts state very clearly that it is strictly forbidden to sublet one’s accommodation and we have a very firm policy” on this, explains to the Free lunch FDI Habitat.
“It’s disproportionate”
For the young woman, a specialist educator for 20 years, this solution allowed her to “offer a canyoning outing” to her children. She claims not to have been aware of the prohibition for a tenant to offer his social housing on a platform.
“It’s disproportionate. I recognize that I made a mistake but there could have been a reminder of the law. Not only am I subject to expulsion but my financial situation becomes difficult when it does not was not before”, testifies to the Midi Libre the tenant, who appealed.
FDI Habitat claims to have offered the tenant to leave the accommodation “amicably, which was refused”.
“Given the situation, we are considering the continuation of this procedure, although this is contrary to our policy of firmness”, however meant the social landlord.
