The decision was made by the Civil and Commercial Judge No. 1, Maria Cecilia Valeros of Coricawho in the last hours granted the precautionary measure requested by the Municipality and ordered the immediate suspension of all the constructions that are underway in the wetland area of ​​Arroyo El Pescado. The decision includes the properties located in the streets 18 to 20 between 670 and 671 of La Plata and those located in the street 18 to 19 bis between 670 and 671.

In its ruling, Valeros ruled “not to innovate, immediately suspending the continuation of all the constructions that are in progress in the wetland of Arroyo El Pescadocarried out without the corresponding authorizations and/or qualifications”.

At the same time, the magistrate ordered that the municipal delegation that corresponds to the area of ​​the stream “arbitrate the necessary measures of custody of the area” with the aim of “ensuring compliance with the provisions”.

The Municipality denounced last Friday the situation of subdivisions and irregular constructions in the area and had requested a stop to the Justice. In the presentation, the Commune assured that the offenders were identified both as a result of neighborhood complaints and controls and operations carried out by municipal personnel. The occupations are located from 18th to 20th streets between 670 and 671 and also from 18 to 19 bis between 670 and 671.

“The works, occupations and tasks carried out by third parties are irregular, which leads to their immediate stoppage, suspension as removal of what was built and/or modified in the zone/area under their sole responsibility and cost,” argued the Legal and Technical Secretariat in the text presented last Friday. And he added: “We cannot ignore the fact that the Arroyo El Pescado wetland has a patrimonial value of great importance for this Commune, since it obeys environmental issues as well as recreational and educational issues of vital importance for all the residents of the city. “.

In parallel, the Municipality also filed a criminal complaint for disobedience on Friday against those who violated the closures ordered by the Justice of Misdemeanors, a criminal offense whose sanction goes up to a year in prison. “Although they were notified of their irregular conduct, they followed the progress,” the presentation explained, adding: “From these inspections, it was possible to confirm works that were 100% executed and inhabited without the corresponding permits.”
