Justin Santos' mother arrives at Teodoro Moscoso after judge suppress evidence

The mother of urban singer Arcángel, Carmen Rosas, stopped traffic on the Teodoro Moscoso bridge this Friday afternoon.

The woman arrived at the aforementioned place after Judge Nerisvel Durán Guzmán, of the San Juan Court of First Instance, earlier declared the motion to suppress evidence of the alcohol test requested by the defense of Mayra Nevares Torres, accused of running over her son, Justin Santos, on November 21 of last year.

It was learned that Medical Emergencies personnel arrived at the bridge to stabilize her, after suffering an apparent nervous breakdown.

The father and sister of Keishla Rodríguez, who was killed and thrown off the bridge, also went to the scene.

“For the aforementioned reasons, the motion to suppress evidence presented by Nevárez Torres is declared valid. Consequently, all the evidence related to the blood sample that was taken, and any of its fruits, is suppressed,” the letter read.

Among the arguments that the defense outlined earlier in an attempt to challenge the blood alcohol test in which he allegedly returned .29%, were that the legal warnings were not correctly issued and that an agent, identified as Benedicto Oquendo, did not sign the legal warnings for Nevárez.

ARCHANGEL REACTS TO DETERMINATION

The singer and brother of Justin Santos, Arcángel, reacted on his social networks to the determination of the court.

“I check again that we have the most mediocre judicial system,” he said after the decision to suppress evidence.

PROSECUTOR WILL APPEAL DECISION

The Secretary of Justice, Domingo Emanuelli, reacted this afternoon to the court’s determination and indicated that the judge erred in law by suppressing the alcohol test carried out on Mayra Enid Nevárez Torres, accused of causing the death of Justin Santos Delanda while driving while intoxicated. Furthermore, he confirmed that will appeal the determination of the Court of First Instance of San Juan.

“The San Juan Prosecutor’s Office, very well represented by prosecutors Edmanuel Santiago Quiles and Jesús Torres González, presented sufficient evidence to demonstrate the consent given by the defendant for the blood alcohol test to be carried out and that said process was done in accordance with the law. Five witnesses corroborated the state of the defendant and the consent granted by her.

The prosecution of Nevárez Torres does not end with this determination. The Department of Justice will now continue in the trial phase until the defendant answers and pays for the crimes that she committed in causing Justin’s death. Our solidarity with the victim’s family.”

WHAT HAPPENED IN THE PRELIMINARY VIEW

The paramedic described the defendant’s behavior as hostile. Already in the hospital, he would have asked her twice why she was there. The man replied that she had been involved in an accident in which one person died. The woman, she said, had no reaction to her response.

In the afternoon, Keven Monserrate Gandía, who was traveling as a passenger with the deceased, testified. The man described the serious injuries he sustained in the car crash and the treatment he received. He had to undergo several operations and is still visited by a nurse at his home.

“It has not been easy, it has shocked me too much,” said the young man about the loss of his friend.

EVIDENT STATE OF INTOXICATION

At that time, the agent of the Highway Patrol Division Benedicto Oquendo Torres testified.

The police officer described the defendant as in an “obvious state of intoxication”, with heavy speech, reddish eyes and a strong smell of alcohol.

According to what he said, at the hospital, while the procedures were being carried out to perform the blood alcohol test on Nevárez Torres, he could see her laugh and become serious.
