The conflict in the Real Property Registry (RPI) of the province of Buenos Aires generated various consequences in different professional fields. The work of notaries, surveyors and lawyers, among others, was delayed, according to various entities and affected sectors.
For example, the College of Notaries of the province of Buenos Aires stated that there were “inconveniences with the entry and issuance of documentation” due to the measure of force that has been carried out since the beginning of March in the Buenos Aires body of 44 between 4 and 5.
“Colleagues are reminded that the delays and inconveniences in the services provided by the Real Property Registry of the Province of Buenos Aires continue, due to the conflict between the employees and the agency. The notaries noted in a statement that “the delays that are taking place in the notarial procedures are not attributable to the notaries, but rather a consequence of the conflict between the employees of the RPI Province of Buenos Aires and the agency, which seriously alters the registry service.” .
La Plata notaries consulted remarked that the situation “is quite delicate.”
A professional said that there is uncertainty regarding the dispatch of certificates, a certain date cannot be given to do the deed and it has an impact in different areas because many need guarantees to move for rent or start a commercial activity.
“There are signed deeds, we finished the paperwork that we have to do but we are waiting for the possibility of delivering the property deed (lot, house or business) to the petitioners. Uncertainty is not a habit in this activity. We hope that everything will be unlocked soon.”
Meanwhile, different surveyors have consulted the entities that group them (the professional association of the sector or the Provincial Council of Surveying) to find out if the conflict is unblocked at any moment.
A domain registration certificate is required to make a subdivision of a lot. The owner is certified. And after doing all the management, the Registry must also be informed about the approval of the plan. Although the Land Registry of the Buenos Aires Province Collection Agency (ARBA) is notified, the RPI must also be aware of the proceedings and issue a final certificate. For example, a change in measurements of a batch of 20 by 30 meters, which becomes two batches of 10 meters by 30 meters, was noted.
“It also affects the registration of plans for gas pipelines and electrical pipelines. The most important thing is the impossibility of obtaining a certificate to manage plans, and the registration of a certified plan certificate. It harms the owners because measurements or subdivisions cannot be made”, they stated in another study with procedures to be resolved.
Another surveyor from La Plata with a position in one of the entities that groups them in the region reported that “to carry out a measurement we need the intervention of the Real Estate Registry and practically no new plans are being processed. In this context, the Bar Association of the Province of Buenos Aires reported that “before the strike by the staff of the Real Estate Registry of the Province of Buenos Aires, without ignoring the trade union right that protects workers to claim for what they they believe that it is fair, we state that it is the duty of the Province to maintain the registry service with respect to judicial orders that must be complied with in the organization”. It was added that “otherwise, legal certainty, the rights of defendants and also the right to work of lawyers in the province of Buenos Aires are insurmountably affected.”
Meanwhile, at the La Plata Bar Association, its head, Rosario Sánchez, maintained that “we are fighting for the hierarchy of lawyers who work in the Registry, as well as lawyers who work independently and need to carry out procedures. The Mar del Plata Bar Association filed a request for a prompt solution to the conflict in the Real Estate Registry. Given the stoppage of the activity, which has been going on for several days, which directly affects the work of legal professionals and the progress of judicial procedures.
For their part, the employees of the Real Estate Registry told this newspaper that “the conflict broke out on March 2. We are self-convened workers, and only one union accompanies the measure. The other two act on their own, at a joint table where agreements were made without listening to the workers”.
They highlighted that “there is a historical demand for hierarchy, so that there is a remuneration in accordance with the collection generated in the organization and for the technical and specific activity that we develop for which there is specific prior training. We have civil and criminal responsibilities.”
Regarding the claim itself, they pointed out that “it is not a fixed sum, increases or additions were granted to the account, which are not remunerative and were outdated.”
Only emergencies are attended to, for example for gender, criminal reasons – in which the freedom of the accused is at stake. The domain and inhibition certificates came to term in a very short term, the resolution period is extended, but they do not expire from the agency, explained the self-summoned workers who participate in the conflict.
A source from the Ministry of Economy of the Province indicated yesterday that “an agreement was reached, activities are already being resumed in the Registry,” and added that “it will be fully operational shortly.”
