Patrick Racz, founder and inventor of Smartflash, has announced the initiation of a civil RICO investigation into Apple, Inc. The investigation will focus on allegations of smartflash intellectual property theft and circumstances surrounding the illegal patent invalidation.

In 2015, Racz won a resounding victory against Apple in court and was awarded initial $533 million in damages for willful infringement by the jury. The key substantive decisions and findings of the case, namely that Apple committed violations related to the technology and incited others to do so, remain unaffected to this day.

From 2015 to 2018, Racz was then forced to defend a series of costly appeals in separate forums, including 48 individual cases before the Patent Trial Appeal Board (PTAB), where the panel of judges included former attorneys for the defendants. Now Racz and Smartflash are taking it a step further by launching civilian RICO investigations. Racketeer Influenced and Corrupt Organizations Act (RICO) is a federal law that allows for the prosecution of any person or entity involved in illegal activity as part of a larger criminal enterprise.

The RICO civilian investigation will be led by a team of legal experts and will focus on gathering evidence to support Smartflash’s claims.
