Since January of this year, the so-called multi-way offer obligation has applied nationwide. This means that Berlin and Brandenburg businesses with a sales area of ​​more than 80 square meters and more than five employees who sell food and drinks outside of the home must also offer their customers both disposable and reusable containers.

A query of the Berlin district offices by the rbb now shows that they only fulfill their control obligation very incompletely. Of the twelve districts contacted, nine have so far not carried out any targeted checks on compliance with the multi-way offer obligation. The responsible regulatory and environmental authorities usually point to a lack of control personnel as the reason.

Only two districts, Mitte and Reinickendorf, have so far carried out targeted checks. The Marzahn-Hellersdorf district office left an answer open at the time of going to press. In mid-April, for example, the public order office in Mitte examined 17 companies in accordance with the new legal basis. All facilities failed. From mid-May, the district office now wants to start writing reports in the event of violations of the multi-way offer obligation. Fines of up to 10,000 euros are threatened.

District Councilor Dr. Almut Neumann (Die Grünen): “Since this year, companies have had to offer take-away food and drinks in reusable packaging. This is an important contribution to environmental protection and nature conservation, because it reduces packaging consumption and saves waste and resources. Especially from the large food chains And after an initial start-up phase, I would have expected system catering to better implement the obligation to offer reusable food. I hope that the companies will now be able to better meet their obligations thanks to the clarification of the on-site regulatory office.”

In Brandenburg, the rbb also asked all 18 local governments. More than half, namely ten municipalities, have not yet carried out any checks on compliance with the obligation to offer multiple channels. The Brandenburg administrations also cite a lack of staff as the main reason.
