CDMX.- The promotion of #EsClaudia by federal deputies from Morena may put the presidential candidacy of the CDMX Head of Government at risk, experts warned.
The massive deployment of billboards throughout the country -nearly 500 structures according to the Morenistas themselves- paid for by legislators, could violate Article 134 of the Constitution, which prohibits disseminating propaganda that includes “names, images, voices or symbols that imply personalized promotion of any public server”.
The resources used by officials to promote the presidential aspiration are also questioned, since they must verify that it is not public money.
It would also violate article 3 of the General Law of Electoral Institutions and Procedures, since they are anticipated campaign acts.
The former president of the then IFE, Luis Carlos Ugalde, pointed out that the Electoral Tribunal affirms that the acts or phrases that are carried out before the electoral campaign stage fall into early campaign acts, the beneficiary is identifiable, and there is an intention to call to vote or ask for support in favor of obtaining the nomination for a pre-candidacy, candidacy or position of popular election.

The electoral law expert Mariana Tamés affirmed that it is not necessary for the campaign they have deployed to request the vote in a textual way for them to be anticipated campaign acts.
“This campaign can cause electoral and control crimes whose most serious consequence would be the loss of the right to register their candidacy,” said the legal coordinator of Electoral Strategy.

The parliamentary coordinator of Morena, Ignacio Mier, urged the members of his bench to calm down.
“That we all put an ice pack on our heads, that we think about the unity of our movement, there are things that do not benefit those who have the legitimate aspiration to participate in something that is substantive for us, which is the continuity of the Fourth transformation,” he said.
